understood, still worth the initial push back
Thanks to everyone for your help! Will get this paid this time and just be mindful in the future of this "ADHD tax"

Signs are high up and the planter text only says enforcement in action, again not from the side I turn but from the main road i turned into.
Idk honestly this feels like a scam and a quick cash grab from the council but if you are saying this is not a guaranteed win I will just pay...

received in post, is it possible to win in tribunal against this? Are planters really an advance warning sign for prohibited entry?

just looked at the page, seems like they rejected it, what can I do now?

18.—(1) Where an order relating to any road has been made, the order making authority shall take such steps as are necessary to secure—

(a)before the order comes into force, the placing on or near the road of such traffic signs in such positions as the order making authority may consider requisite for securing that adequate information as to the effect of the order is made available to persons using the road;

(b)the maintenance of such signs for so long as the order remains in force; and

(c)in a case where the order revokes, amends or alters the application of a previous order, the removal or replacement of existing traffic signs as the authority considers requisite to avoid confusion to road users by signs being left in the wrong positions.

Advance warning signs tend to be of two types, (1) text on a blue background with sometimes an arrow indicating next turn left or right, and (2) diagram of junction in black on a white background with the barred street have the Flying Motorbike sign. I consider (2) is best.

If you submit reps to Haringey within the discount period, they normally re-offer the discount when rejecting to encourage you to settle the matter. If you take them to London Tribunals they have the PITA of having to prepare an evidence pack and to pay the adjudication fee.

I have put together my response to them above, would this be ok?
Apologies for tagging everyone, but only got like a day or two to send this

Post your draft reps here for comment before submitting (but do not miss deadlines).

Make reps as if from wife and where if coming from you they would have said "I"/"me" replace with "the driver".

If it comes to adjudication then your wife can give you a written letter of authority to act as her representative.

let me know if this is ok to send them, thanks!

not 100% sure of the format as this is my first such PCN in 15 years. I put together this, please let me know if I need to amend anything. Thank you so much!

I would like to challenge this PCN as it was issued unfairly.
On the day the driver was taking the Myddleton road in an area never visited before. Navigation was suggesting a left turn and the driver has assessed the situation and checked for signs and took the left turn. Myddleton road does not have any signs prohibiting left turns of any kind on to Marlborough road. During the manoeuvre a sign prohibiting entry without a permit has revealed itself. As it is facing towards Marlborough road, it meant that at the time of noticing this sign it would be too late to change direction without suddenly stopping and risking causing an accident. Therefore the driver has made a decision to continue forward.

It is the councils duty under Regulation 18 of The Local Authorities’ Traffic Orders (Procedure) (England and Wales) Regulations 1996 to erect adequate signage of a traffic restriction. In this particular case the sign appears well into the manoeuvre without adequate warning beforehand. This situation and the reception of a PCN has already caused significant distress to the driver, which I hope was done accidentally and not maliciously.

I am therefore asking to cancel this PCN and re-assess this turn in particular and add additional, legally required signage.

Oh one last question before I get it done - this is my wifes car and the PCN came under her name so is it ok for me to fill it out with my details? It's the same address just different name. I am named on her insurance and I was driving that day

Noted, I did look around as I know there may be surprises but never saw this coming.

A few questions here:
- What does an advance warning sign look like, same as the warning on the street but also highlighting that it's for the left turn?
- The page you linked to has a lot of legal speak there, which line specifically mentiones adequate signage?
- If they reject, could I still pay the reduced rate or have to go to tribunal?

Thanks so much!

Hey all,

So just got this in the mail. So I was essentially following Myddleton road using navigation and it told me to take a left onto Marlborough road. As soon as I started turning I noticed the sign which limits cars and bikes unless having a permit. It was too late to do anything anyway so I carried on. Anything that could be done here?
This is the point, I essentially took a left here. https://maps.app.goo.gl/y9uzjpbXsyaZsXQ39

Here is the PCN, photos and video
