Hi all,

Firstly, I am the registered keeper of the vehicle in question.

The driver of the car parked up in the pizza hut restaurant car park late in the night with full intent on being a customer, before realising that the location was shut and not serving. They then sat in the car park to search for an alternative location, before setting off (10 minute stay). The car park is managed on behalf of pizza hut by MET Parking services.

At this stage, the driver has already appealed with MET (without consulting here, meaning the appeal was not as well thought out and detailed as it could have been). This was unsuccessful Therefore the next appeal will be with POPLA. Here are the current arguments, looking for advice on how to formulate a POPLA appeal and whether there is a good case here to have the ticket successfully disputed.

1) The Pizza Hut in question is no longer in operation. When receiving the ticket, the driver contacted Pizza Hut to resolve the issue, to which they replied "As the Hayes retail Park Hut has now permanently closed, we're unable to intervene directly with the parking company ... Pizza Hut do not own the car park, thus are unable to help". The signage states that MET operate the car park on behalf of pizza hut, how can that be possible when the location is shut and hut claim to not own the car park.

2) Times of operation. As stated on the signs, the only way to authenticate your car parking is by being a customer and registering your Reg at the front desk. Again, this is impossible to do when the site is now closed. There is no signage indicating opening hours or that the site is closed when entering the car park or on the car park signage. There is also no instruction on what to do if you have entered outside of operating hours.

3) Likely less important, but at the time when the driver entered the car park, the retail park where this hut is located was obviously not busy. This means there where 100's of parking spaces available which would not have caused penalty. Therefore, this backs up the claim that the driver was 100% intending on being a customer, but was not able to due to the site being closed.
