I have the same code PCN, from exactly the same location with Havering. I also appealed and it was rejected, missed the first reduced rate date as we have been dealing with a family bereavement however would still like to go to tribunal - just unsure on the best argument? Lack of signage, incorrect road name, video does not show my vehicle passing any signage?

@HBFOOT Where is the Notice of Rejection please? I would suggest that @mrmustard or I offer to represent you. I annoyingly lost a case the other day (considering a review application). And I have my own to deal with in June.

Thank you for reviewing, and looking at the signs. As I said, it was a dark miserable evening and we were rushing to get to our very unwell MIL.

In my argument to tribuneral then do I push with the argument, that the evidence they have provided does not show the car registration passing any of the restricted signs? I feel a little uneasy putting together the argument as I know these councils are pesky!

Happy to liase with you direct if easier?

(annoyingly on the same day we received a code 31 PCN which we are also in the process of appealing, we were rushing to get to our Mother in law, who is terminal.)

They are stating I went down a no entry, however I do not recall seeing any signs, it was fairly late & dark and the video evidence they have provided doesn't include a working video.

I used the argument provided on a previous chain seen on this website, but have received a notice of rejection, i'm stumped as normally when you appeal the reduced rate is paused however this is not the case, so they are expecting the full £160. Would be great to know if we have any case at all?

Its likely we will have to folk out £320 for 2 PCN's on the same day, which given other stresses we could really do without!

I received two PCN's the same day from Havering! Feeling very frsutarted about having to potentially pay £160, and both PCN's are unable to show videos.

Tribunal time. NOR also does not state the adjudicator may extend time. Drop me a PM if you want me to represent you. Total failure to consider the issue as highlighted.

@Hippocrates Thanks for your response.... Shall I just stick to this ... also the grounds on which website, sorry i'm a bit confused here.

I contest this PCN on the following grounds:

1. The PCN is Missing Mandatory Information
Under London Local Authorities and Transport for London Act 2003, Section 4(8)(v), a PCN must state:

“that, if the penalty charge is not paid before the end of the 28 day period, an increased charge may be payable”
and
“that the penalty charge must be paid before the end of the period of 28 days beginning with the date of the notice.”

This PCN fails to include the second requirement in full and instead uses wording that conflates payment and appeal timeframes, rendering the notice unclear. As the PCN omits mandatory statutory wording, it is invalid and must be cancelled.

2. Lack of Evidence of the Alleged Contravention
The CCTV evidence provided by the authority does not show my vehicle passing the relevant restriction signs. It merely shows the vehicle already inside the alleged restricted area.
Since the PCN is based upon a breach of a prohibition conveyed by prescribed signs, the absence of these signs in the evidence means the contravention has not been proven.

Given the above, I request that this PCN be cancelled.
