Dear Mr

Request for Erasure of Personal Data

We refer to your request regarding a request for erasure of data.

Unfortunately, we cannot process your request because we can demonstrate legitimate grounds for the processing of your data, which override the interests, rights and freedoms of you as an individual.

That legitimate interest being that we are acting on behalf of our client Horizon Parking Limited for the recovery of monies relating to an unpaid Parking Charge(s), number(s) HP3705121.

To process your data is necessary and lawful, as it is required in furtherance of our clients instructions, and we act for them on their rights and obligations for the recovery of such monies.

If you have concerns over our clients processing of your data, you will need to raise the same to them directly as they are their own Data Controller under the General Data Protection Regulations with their own obligations.

Any insinuation this firm is acting in breach of its own obligations under the GDPR is refuted, as established above the processing of your data is done in accordance with the GDPR.

If you are not satisfied with our decision, you have a right to complain to the Supervisory Authority. At this stage you should contact the Information Commissioners Office (ICO);

Address;       Wycliffe House
Water Lane
Wilmslow
    SK9 5AF

Telephone Number    0303 123 1113

Please note that time limits may apply and so you should contact the ICO as soon as possible following our decision.

We must also confirm that you also have the right to a judicial remedy (ie claim compensation through the courts), if you remain unsatisfied with the outcome of a complaint to the Supervisory Authority and you believe there has been a breach of the General Data Protection Regulations 2018. The ICO cannot award compensation and so if you cannot reach an agreement on the amount of compensation where appropriate, you can apply to court.  You should seek independent advice at any stage that you feel it necessary.

We hope the above provides clarity to you with regards to our decision, but should you require any further information, or have any concerns, please do not hesitate to contact our Compliance Department;

The machine has 'Predictive' text and as you type Registration number selects for you (if that makes sense?)
Also, no slip is printed by the parking machine, it's all online/automated.

NTK issue reason is - Failure to pay for full duration of stay.

ANPR captures on the way in but most likely is not/ can't assess how busy the parking is.
It may well take 5 to 10 minutes on a busy day/weekend to find a bay, then due to having to exit in to a main road,  there can be traffic build up leading out (as this exit ANPR pic shows a queue leaving).

Surely no Judge will entertain 11 seconds overstay as an ACTUAL overstay?

Sorry for the waffle, anything to do for me at this point please?

ANPR shows entry at 15:45:19.365

The parking payment transaction time shows 15:49

ANPR shows exit at 16:45:31.751
(Not sure what the Decimal is about!)

Vehicle is owned by me. I am not sure who was driving at the time of alleged Parking Charge from MET Parking at Target Roundabout McDonald's in Oct 2024 as moved house in Dec 2024.
I had suffered a recent family bereavement and was going through a period of depression.
Due to this, I don't have the original charge letter, only what is attached through link.
