The fact that someone else was driving is irrelevant, the owner is responsible for a council PCN no matter who was driving.

That being said, if you simply forgot to update the V5C you would not an out of time application to the traffic enforcement centre accepted, so I'm afraid you'll probably have to put this one down to experience.

Sorry I just read the last bit where you said "...not an out of time application..." and I wasn't sure what that meant.

I think you meant that it wouldn't be accepted but I wanted to check in case it happens again!

Thanks! For future if I would have not panicked and collected the PCN letter, logged in and just paid the Hounslow £204 fee, would Marston have gone away or would it have been too late for that?

I've now got hold of the original PCN from Hounslow and when I enter the details on their website it says £204 outstanding. I presume this is because Marston Recovery services will take their time informing Hounslow?

Hello,

I think this is too late to do anything but I wanted to check.

Last week "Marston Recovery" put a final notice on the windscreen of my car saying I owed £514 for an unpaid PCN to London borough of Hounslow.

They said they would take the car away that day. I'd never heard of this fine before because I'm an idiot and I forgot to update my V5C two years ago (that's now up to date).

Unfortunately I felt completely overwhelmed and paid Marston Recovery because we needed the car. My wife is about to give birth any moment and it panicked us not having the car.

Now the dust has settled I've realised someone else was driving the car. So I could have appealed it!

I realise I should have appealed before paying but I was too stressed to think clearly. I'm assuming there's nothing I can do now it's been paid but I wanted to check if there was any way to appeal at all?

My work contacted "Creative Car Park" and there has been some good news, here's what they said:

To support you where we can, I have cancel 16 PCNs that are in reminder stages and have no esclated. The driver will receive a letter my post to confirm the cancellation.
There are 10 PCNs that are at LBA stage which are just before the court stage, I am more than happy to reduce each of these PCNs to £20 rather than £170 - £180 as per the BPA regulations.
And finally, I was able to speak with the legal team and reduced the CCJ PCN from £300 to £95.
To have the CCJ removed, the driver can contact our legal team to discuss further.


So I'm going to pay the outstanding £295. Their legal team have sent me a document where they suggest the judgement be set aside and I will send this to the Civil National Business Centre to appeal the CCJ which will cost me £100 or so.

Big lesson for me in terms of the V5C.

Hello everyone,

I'm struggling. The shame and embarrassment of racking up all these fines is hard to cope with but now I know the scale of the problem I'm hoping I can sort it out.

I moved house 3 years ago and forgot to change my V5C. I'm such an idiot. I changed my driving licence and everything.

My work handed over its car park to creative car parks. They started recording reg plates in 2021 and since then I've racked up 27 fines. I only found out yesterday as the old tenant said he had 100s of letters for me, which I went and colected.

There is one about a CCJ which has turned up on my credit score. Most of the rest are with "QDR solicitors" now. They are £170 each and are being handled by "Civil Enforcement".

My work says they can't do anything to cancel the fines but they have sent emails to both Creative Car Parks and Civil enforcment asking for the fines to be cancelled.

Through the Civil enforcement website I have appealed each fine essentially saying "everyday I parked there I was working and there was a mistake adding my details to the car reg database".

1. Should I appeal the CCJ, will my reason work?
2. I could wait 28 days before I hear from Civil Enforcement, does anyone have some experience on whether what I've done will work?
3. I feel like speaking to a lawyer would help, does anyone have any advice?

UPDATE:

1. I'm on the phone to QDR solicitors. I want to make sure no further CCJ orders are submitted. Now that I'm appealing the fines do they have to stop any further action on the CCJ front? I saw on CAB this line: "Under section 40 of the Administration of Justice Act 1970 and section 2 of the protection from Harassment Act 1997 you cannot send any other letters etc." Is thee anything else I should say to them?

2. I was going to appeal the CCJ. Is it best to do this by completing the "defence" part of the CCJ form or sending a N244? Or both?
