My initial appeal was rejected. I then appealed to London Tribunals and TFL pulled out before the hearing. Justice served.

Hi everyone,

Hope you all are well.

I had received a Penalty Charge Notice from TFL for “stopping where prohibited (on a red route or clearway)” — contravention code 46.
Location: Outside 29–31 Stoke Newington Road, N16
Date/time: 12th October at 17:49

I stopped briefly (under a few minutes) to load goods, in what I believed was a loading bay. Since it was a Sunday and I was in the usual 7am-7pm loading exception for nearly everywhere else, I thought that loading in the bay was fine. Senseless mistake on my side. I believe I stopped confirmed the restrictions (due to it being dark) and thus left within a minute as noted by TFL on rejection letter.

I appealed telling them the same scenario and received the rejection this morning. The noted the only observed me stationary for 1 minute (noted on letter). However in the letter I think (May be wrong) that they made a mistake. The claim the signage indicates 'no stopping Mon-Sat 7am-7pm except 10am-4pm for loading'. However on the signage it is actually no stopping at any time except 10am-4pm for loading, except taxis 7am - 7pm.

I am therefore asking here if I have any chance at an adjudicator appeal or should I just pay up for this mistake?

Thank you for your advice :)

Hi everyone,

Hope you all are well.

I’ve received a Penalty Charge Notice from TFL for “stopping where prohibited (on a red route or clearway)” — contravention code 46.

I’ve checked the TfL evidence photos, which show my vehicle within the marked bay. I was genuinely there to load and didn’t realise that the loading hours had already ended. I got evidence of loading if needed.

I’m planning to make a polite representation explaining the circumstances and asking for discretion, as I was using what I believed to be a permitted loading area and was only stopped briefly for legitimate loading.

I would like to ask for any advice, either improving my reps or going a different way.

Thank you for your time, it is really appreciated.

Dear @Pastmybest,

Thank you very much for your help I submitted those reps on time! Apologies for the delayed response:))

Dear @H C Andersen,

I agree with you, that is what I thought as well. But my discount stage was until 7th October confirmed by their website and a council agent I called. Apparently they add extra time for discount stage due to post taking too long sometimes?? According to the council worker.

7
Dear @Pastmybest,

Thank you! Appreciate it. Hoping to submit by tonight during discount stage.

8
Hiya @Pastmybest,

Just reminding regarding the reps, thought I'd wait a bit past Sunday but representation is due in a few days.

Thank you for your time.

9
Dear @Pastmybest,

Thank you very much, I truly appreciate your help.

God Bless.

So look at the council evidence, What sign?

Dear @Pastmybest,

Thank you for your advice. Could you please advise on what points I should make in my representation. Been extremely under the weather so been afk last few days.

Thank you for your time :))

11
Dear @H C Andersen,

Ahh I see, what points would you recommend I state in my reps?

Yes I am the registered keeper.

Thank you for your time and help mate.

Kind regards,
Ali

Dear @Hippocrates

Just saw the PM, will not pay!

13
Dear

Thank you for your advice, I really appreciate your help. I will do that and wait for Hippo's input.

I have read a pervious thread for 32d on this same street, on this website, and the PCN was fatally flawed in that case, could that also apply to my case as I think I have the same wording in the second sentence under the evidence pictures.

14
Dear @stamfordman

I am pretty sure I did not go down through Sweeney Crescent as there is a banned left turn sign and clear markings on the road before turning too. I think they would've definitely included that in the evidence for the PCN as it thoroughly backs up their case, but they did not.

What would you advise I do?

Thank you for your time.
