hello again guys
@jfollows@b789@DWMB2 you guys are awesome throughout this and I want to take this opportunity to thankyou all for your continued guidance. I have finally received an email yesterday from DCB Legal stating their client has instructed them to discontinue court proceedings and close our file enclosing the Claimant’s N279 Notice of Discontinuance for my record.

Should I be helpful and adding value to this forum please let me know the ways. I feel indebted to this forum as it has taken me out of this mess causing awful pain and discomfort.

@b789 and @jfollows Sorry to get back to this its been a while.
I like to thank you guys again for such a valuable guidance.
@b789 they tried to push a lot with threating and legal language over the phone but I knew nothing but your script and it has done wonders. Its been over 3 months and haven't heard anything from since then. I assume its all over and like to thanks again for your time and support. I would love to add up to this forum as much from side as I can or if there is something else I can do please let me know together we can make the difference.

Dear @jfollows, as per your suggestions to fill out the N180 DQ form. I have almost completed the form, being mindful of the instructions but I got stuck at Section E 'About the mediation appointment'. Whose details should I have to give in this section? If you can guide me on this please.

@jfollows I will now go on to fill and submit my own N180 DQ as per your suggestion using the provided link and mindful of your advice when choosing options whilst filling it out.
@b789, No, I haven't redacted the name of the person who signed that N180 DQ from DCB Legal on purpose.
Should I have posted that email or attachment in any other way or differently, please do advise me and I shall follow.

Having submitted the defence online through MCOL. I have now received an email from DCB Legal on 17 sept 2025, along with attached HM Courts and Tribunals N180 Directions questionnaire
(Small Claims Track).

I have drafted the following letter in my appeal...I wonder as if how exactly I check with the council for where the public highway ends and the private land begins as per your suggestions?

Subject: Parking Charge Notice [reference number] – Appeal

Dear Sir/Madam,

I am the registered keeper of the vehicle referenced in the above Parking Charge Notice. I write to appeal this charge.

The alleged contravention concerns parking on a single yellow line. I dispute liability for the following reasons:

Misleading Road Markings
A single yellow line is a statutory highway marking, enforceable only by local authorities under traffic regulations. On private land, such markings have no legal effect. Their use in this context is misleading, as a reasonable motorist would assume the restriction related to public highway rules rather than a private contractual term.

Inadequate and Unclear Signage
For a parking charge to be enforceable, the terms must be clearly displayed and capable of forming a contract. At this location, there was no clear signage stating that parking on a single yellow line would give rise to a financial charge. Without clear and prominent signage, no contract can be established with the driver.

Request for Discretion
This appears to be the first occasion the vehicle has been issued with a charge at this site. If any term was inadvertently breached, I would ask that you exercise discretion and cancel the charge as a gesture of goodwill. Steps will be taken to ensure the vehicle is not parked in this manner again.

For the reasons above, I request that this Parking Charge Notice be cancelled. Should you choose not to do so, please provide the following so that I may properly consider further appeal:

A copy of the contract with the landowner authorising enforcement.

Photographic evidence of the signage in place on the date in question.

Clarification of which Accredited Trade Association you are a member of, so that I may escalate this appeal to the appropriate independent body (POPLA or IAS).

Hi @DWMB2, Thanks for your prompt response. I have now gone through the thread you mentioned in the post earlier. I will be mindful of the advice mentioned in the thread.

Further to the post, I have attached the pictures from google maps as well as from the NPM portal images taken by ANPR. The car was parked exactly where the white van is parked in google map image.
