Hey there - I wondered if you would be able to help me with what key points to focus on when drafting my appeal to POPLA. Do you think it is best to focus on the lack of signage indicating the space could not be parked in? Thanks.

Hello, thank you for your reply - sorry I didn't include all of that in the original post.

Attached is the letter they sent me in the post, details when I go to the online portal, my initial appeal & a close-up of the T&Cs at the entrance to the car park.

I believe I have identified myself as the driver in my initial appeal although I'm not sure because I dont explicitly say.

As you can see their reasoning is simply "No parking at any time" for the fine - which I simply do not understand. I have read the T&Cs at the car park and I was not in breach of any of the points under part 5 "Contraventions". They had not marked the bay I was in with any signs indicating it could not be parked in & the pictures they gathered as evidence do not show any signage - they are literally just pictures of my car (which is definitely within the parking space).

Their reasoning for denying my initial appeal reads exactly: "Your appeal has also been considered in conjunction with the evidence gathered at the car park on the date in question. Our records show the notice was correctly issued as your vehicle was parked in breach of the Terms and Conditions of Parking."

It all seems quite vague and I really dont think I have done anything wrong. If I knew I had done something wrong I would just pay it but it seems blatantly unfair and frankly I dont just want to give in and pay them off.

Any reply / advice is much appreciated - thanks.

Hi there, a few weeks ago I parked in an NCP car park which I regularly use each weekend. I received in the post two days ago a fine for £100 (reduced to £60) for breaching the Ts&Cs of the car park - "No parking at any time". They go on to state that this was brought to my attention through clear signing around the car park. I have used this car park for two years now and this has never happened. I have attached an image of this signage. I would argue that this is unfair due to how small the font is, and the fact that the NCP app allowed me to purchase a 24hr ticket for a period in which apparently I'm not allowed to park. I was parked fully within the parking space and the incident occurred within the parking session I had paid for.

I have since appealed this with NCP, which they promptly declined and reasoned it with "Our records show the notice was correctly issued as your vehicle was parked in breach of the Terms and Conditions of Parking." This is quite vague in my opinion and does not actually state what I did wrong.

I'm now considering escalating the appeal to POPLA. I want to ask is this wise? I will be losing the discounted fine of £60 if so and will have to pay £100 if I lose my appeal. Frankly this has rubbed me the wrong way as I dont believe I have done anything wrong and I dont exactly have £60 or £100 to just be giving away to some greedy parking company, you get me? Any advice is appreciated - thanks.
