Tribunal has ruled in the past that a 3 month delay is unreasonable. Bide your time and hope that 28th July comes with no response (It will - I’m still waiting for a CCTV PCN issued and appealed in Feb)

If you do get the notice of rejection. Come back here and people can assist with going to tribunal.

Atherton Road is a quite long road with many side roads coming off.

If you could post a google street view link to about where you parked, other members could have a look at signage.

This seems pretty simple. Ealing councils own website of school streets says your exact point. (https://www.ealing.gov.uk/info/201146/neighbourhood_and_streets/2610/ealing_school_streets)

I’ve had a look at the ticket online and it appears you’ve submitted representations already. I assume you’ve outlined that it was an inset day etc.

If you get a notice of rejection, they’ll re offer the discounted rate. Come back here and show the rejection to get advice before just paying. There may be other members that can give advice on statutory grounds for appeal at tribunal.

My experience with Ealing council is that they can’t keep up with all the PCN rejections. My mother had a similar postal PCN and they’ve taken so long to reply that if they reject it, we can now take it to tribunal

Having reviewed the CCTV footage, I would respectfully ask the council to reconsider this PCN and exercise its discretion to cancel it.

The footage begins with the vehicle already within Sawley Road and does not show how the vehicle arrived at that location. The only manoeuvre captured on the CCTV is the vehicle turning around and leaving the area.

My mother had recently been served with a Section 21 notice and was viewing potential alternative accommodation in an unfamiliar area. She was understandably under a significant amount of stress at the time. Upon realising that she had entered a restricted road, she immediately turned the vehicle around and exited, as shown in the council's own footage.

The CCTV does not show a driver continuing through the restricted area or seeking to use the restriction as a shortcut. Rather, it shows a driver who recognised a mistake and took immediate action to correct it.

If the council considers that a contravention technically occurred, I would respectfully submit that any breach was de minimis. In other words, any breach was so trivial and insignificant that it would be disproportionate to enforce the penalty in the circumstances. The vehicle did not proceed through the restricted area. Instead, my mother immediately turned around and left as soon as she realised her mistake.

The council's own CCTV footage shows that the sole manoeuvre captured is the vehicle turning around and exiting the location. There was no attempt to continue through the restriction, gain any advantage, or use the route as a shortcut. The footage is entirely consistent with a driver who recognised an error and took immediate steps to rectify it.

I appreciate that restrictions of this nature serve an important purpose, and my mother regrets the error. However, given the particular circumstances, the immediate corrective action taken, and the minimal nature of any breach, I would be grateful if the council would exercise its discretion and cancel the Penalty Charge Notice.

Right, I’ve had a drive down to the area and there is a flying motorcycle sign on the other side.

I think this is now a de minimus/discretion argument. Here’s the reps I’ve come up with

The authority’s evidence does not establish the alleged contravention.

The CCTV footage relied upon by the authority does not show the vehicle passing any prohibition sign or entering the restricted area. The footage commences with the vehicle already present within Sawley Road and records only a turning manoeuvre. At no point does the video show the vehicle approaching the restriction, passing the signs, or crossing the point at which the restriction begins.

The authority may invite the council to infer that the vehicle must previously have passed a restriction. However, the CCTV evidence itself does not show this and therefore does not directly establish the alleged contravention.

If, notwithstanding the above, the council is satisfied that a contravention occurred, I submit that any breach was de minimis.

The CCTV footage shows the vehicle immediately turning around and leaving the area. The driver did not continue through the restricted zone and did not use the restriction as a shortcut or to gain any advantage. The entirety of the footage is consistent with a driver who realised a mistake and took immediate steps to correct it.

I also ask the council to exercise its discretion to cancel the PCN.

No, not quite
The 56 days is the mandatory response period for formal reps against a Notice to Owner under the Traffic Management Act, so doesn't apply to your mum's PCN which is under the LLA & TfL Act 2003

However, London Tribunals have made clear that delays of more than 3 months in replies to formal representations ca be considered unfair and grounds for cancellation of a PCN unless the authority have a very good reason.

So, that leaves 30th June being 3 months from the latest date reps could have been submitted.

I won't poke the bear and hope nothing comes back in the next 10 days.

How long since the reps were submitted ?

I don't have an exact time of them being submitted but they were submitted in the 28 day window. The system is showing add further information in place of challenge. The end of the 28 days to submit reps would be 30th March.

I believe you're getting at the 56 day statutory requirement to reply. If reps were submitted at the latest date - they were submitted much earlier - the latest they could reply would be 25th May.

Have I got that right?

My mum just reminded me that she hasn't heard back from ealing council regarding this.

I've had a look at the PCN on the system and it says that a NTO has been sent, I'm assuming this is the inital fine received through the post. No Rejection of reps or anything from the council?

I would assume it would be taken off the PCN system if there was an acceptance of reps. Should I chase it up or wait?

Hello people,

Once again it appears my mother may have fallen fowl to one of the LTNs. This time, the council may have slipped up and I'd like some opinions.

I'm not sure on the PCN but the video shows the vehicle already past the sign by a decent distance, so no offence proved?

I’m a local to that area. That is the location.

Funnily enough, the footage comes from a car with a mobile camera which is ILLEGALLY parked in a loading bay but it’s all fine because it’s a council contractor.

The reason was she was viewing a house as we’re currently waiting for court documents to come after receiving a section 21.

I’ve attempted to get Ealing Council to use their discretion before when I got a parking ticket outside my house after spending the whole night in A&E. I don’t have a permit because I’m usually at work at times of enforcement. They didn’t even acknowledge my reps and simply said I was observed by a CEO parked without a permit.

I will try at the very least because at least it will give her a little extra time to pay. Will probably write up the reps and submit on the last day to give even more time.

GSV is 5 years old in the area and shows completely different restriction times.

My mum has received this in the post. She’s completely bang to rights on the offence even if it is only 5 mins.

I’ve had a brief look for any procedural issues on the PCN, however, can’t find any. Wondering if another set of eyes can see something before she gives this money hungry council any money.

As one saga comes to an end another starts.

I have had a PCN from Met Parking Services for overstaying, however, they’ve linked two separate stays.

The driver went to this particular McDonald’s after a lengthy visit to the hospital up the road. The driver then had work the same morning and went through the drive thru to get a coffee having not had much sleep.

I have called the McDonald’s and they didn’t pick up so I went in and spoke to a manager who refused to do anything.

I have a dashcam in my car, so can easily prove this is their error. What is the best course of action. I’m thinking of appealing as RK and providing the dashcam. Should I also complain to DVLA and ICO regarding the misuse of my data? How would I go about that?
