You are probably correct, I think myself I am overthinking this, probably due to having heard nothing for almost 4 years, then when the govt decides to implement new legislation governing these companies then suddenly they get back in touch again.

Sorry, I should have explained better. I meant I was aware of there being no keeper liability in Scotland, as in that's the law here, no liability if you're not the driver.
But new legislation was introduced in June 2022 regarding the 5 year (6 in England) timeframe they have to still pursue their claim through the courts, and it's this new legislation I am worried might affect my defence if they choose to challenge who the driver was, can they still do it outwith the 5 year timeframe.

Good afternoon.
I have 2 private PCNs, both where I wasn't driving my car, from June 2019 and March 2020.
I am aware of the keeper liability law in Scotland, but it's the prescription and limitation that I am worried about. I know they have 5 years in Scotland to claim this, but the law recently changed with effect from June 2022. How does this affect my defence in respect of using this argument also? Is the 5 years still over? Or do the provisions in the new laws negate this argument?
