Speeding and other criminal offences / Re: Have I been caught?
« on: September 03, 2025, 01:45:49 pm »
I'm not sure where to post this but for the timebeing I hope this is the right place.

I'm asking this on behalf of my sister who works within the complimentary medical profession and is very busy and doesn't in anycase able to challenge things. She has had 3 things in the last month.  A box junction ticket, a Gatwick airport drop-off ticket and a speeding ticket.

I have posted for advice for the first two and we're dealing with them.  As regards the speeding ticket, by the time I found out about it, she had already sent back the registered keeper form to say that she was the driver.  Obviously I can post anything later. I don't know what the charge of the alleged speed was compared to the Zone, but I can find out.  Probably only marginally over.

My initial question is this.  She went on a speed awareness course for a previous offence almost 3-years ago.  As I understand it, you're only allowed to do a course once every 3-years. If she is not allowed to do a course, she would then be on 6 penalty points - starting to make insurance which is already painful even more painful!  When she receives the 'charge sheet' back in her name on the basis that it doesn't offer a 'driver education'course,  If she is close to the 3-years, would it be worth writing a grovelling letter to the 'officer in charge' requesting a course instead of the fine and PPs?  Has anyone experience of success in this area or is it down to the minuture of exact days?

Thank-you. Yes I found that. There is a webpage with that number and info for appeal at:

https://tfl.gov.uk/modes/driving/red-routes/penalty-charge-notices/make-a-representation?intcmp=2234

I was able to request the video by way of a DVD and the lady has put the matter on hold for another 14 days. Unbelievably there's no charge to be sent the DVD. Of course they don't tell you anywhere on the webpage that you can verbally request the video!   Also seems to be ridiculous that they can't put the matter on-line somewhere to be viewed.

What? Just tell her to call them to request the video.

I'm not sure how easy that will be?  There's no phone number on any of the PCN - 4 pages in total. It seems these things are dealt with up in Darlington.  On the TFL website there is a generic phone number which is 0343 222 1234.  I can only imagine that this has endless tiers of push button menus with no push button menu to represent our request, but we must try.  Would matter need to be put on hold? I can't imagine TFL being quick in providing anything and a week has gone by already.

Failing that it seems that we will otherwise have to complete the form.  They should however be happy with a photograph of a Driving license? That's in colour with a photo, confirms name and address.

The form otherwise is at:

You(r sister) needs to request the video from TFK - they only send it out on DVD.

See also the sticky above: https://www.ftla.uk/civil-penalty-charge-notices-(councils-tfl-and-so-on)/tfl-red-route-postal-pcns/

Thank-you.  I have done some research and there is a Word document to fill out to request it and it's only by DVD as you say, presumably sent by snail-mail.

I have noticed that they are also requesting a  "recent full-length colour photograph of you" in addition to providing ID & proof of address. That is super creepy! Why would they need that?  There must be a way of contesting that such that the photo does not need to be included, so long as ID & proof of address is provided, and they would HAVE to provide the DVD of the video.  It seems that they are being deliberately obstreperous and simply want to make it hard to appeal.

I am just writing this on behalf of my very busy sister who is not a member and doesn't know how to appeal and challenge these things.

She got a PCN in the London Borough of Richmond Box for straying into a box junction grid on the Upper Richmond Road West on the way to a patient. This was back on the 14th August but the date of issue was the 28th.  Is this too long?

Seems to be a TFL administered PCN.   I recall some ten years ago, the wording on the TFL ticket wasn't legally compliant which was the basis of a successful appeal at the time. I presume that has long since been corrected?

Thank-you for this. We'll try and do this online which is what the PCN recommends.

I am just writing this on behalf of my very busy sister who is not a member and doesn't know how to appeal and challenge these things.

She got a NCP automatic penalty just for going in the wrong place at Gatwick airport as a result of being lost whilst trying to leave. She had actually legitimately paid for parking elsewhere whilst she went away for a few days. She hadn't even stopped to drop someone off!  Date, 17th August.

Some very kind advice sought as to how this can be defended. Very Unfair.  They're private tickets?

In the Daily Online version there is an article in the premium paid version, on how to beat private tickets with advice from a retired judge.

The article is titled:

"I’m a retired judge and this is how to beat a private parking ticket: What you need to know as fines rocket"

This is a link to the article, but it requires paid premium 'Daily Mail plus' membership, in order to read it. Has anyone seen the article and been able to read it?  Presumably it will have been published in todays' hard copy version available at the newsagent.

"Just some preliminery advice

Late one evening recently, I drove through a temporary 50MPH speed limit on the M25 in surrey.  I was doing 56MPH according to my digital display speedometer.  I had cruise control on for 56MPH as I didn't want to annoy lorries who like to go at this speed or faster.  A camera on the gantry flashed twice as I passed. I know it must have been at my car as my car was the only one going through at that time. Am I likely to hear anything?  I have heard that just because a camera flashes, it doesn't necessarily mean that a photo is taken and also even if a photo is taken, if speed is deemed within a possible grace/tolerance margin, once again it might not follow that the driver will be necessarily pursued?  Just interested to  what others think at this stage."

It's good to be able to report that it's now been 2-weeks + 4 working days since this incident and I have not heard - the post has been for today.

Thank-you, both of you. I wrote the reply to Global which went through just before seeing your post Karma.  I'll update this if I hear anything or even if I don't allowing for expiry of statutory time periods!  Thank-you

Thank-you.

I think it will have to wait to see what happens.  Gosh if my speedo underreads, then I could have been going as fast as 60MPH!  I have never heard of overreading speedometers but i suppose it's possible. I have also heard it said that 'margin of errors' are usually in the driver's favour, but that can't be always the case as this website wouldn't exist!

The guide at the side marks me as a Newbie, however I was a member of the predecessor site, Pepipoo for many years, now switched off.

Thanks for the reply.  I don't have any memories of the signs.  I do remember seeing something saying 'Bus Gate' printed in white on the road.  I just don't know Bristol and was a visiter there that day.  It's 100 miles away, so not worth going back to have look at signs etc

Here are pages 3 & 4 of the PCN:
