Hey All- just an update from my side as i have recently received my referral to court summons for a hearing.
As mentioned I will be running a special reasons case - Andy provided some great direction on another forum which i have taken up I have emailed and sent letters to the court confirming to place on record that my guilty plea is on the basis that my partner or myself did not attempt to secure insurance cover after or during I was stopped by the police. Cover had been purchased before I began driving. I therefore disagree with the statement of [PC XXX] and object to its contents being used as part of the prosecution's statement of facts. Although I plead guilty I intend to argue that there are "Special Reasons" not to endorse my driving record and impose penalty points or a disqualification.
In my mind my story & reason for driving can be heard at the special reasons hearing however i must first ensure that the view that i purchased insurance after the stop is out of the mind of the individuals judging me. I now recollect from memory that the basis that the officer said i purchased after the stop was because the start time was 12:30 so they assumed it was purchased after 12:15 (stop time). Which can be disproven by the Bank statement transaction time of 12:08.
Any thoughts or direction again appreciated i will update as we go.
