Just checking it's possible to read that google doc!

I've still not received a response from Merton Council re the final order, but with time ticking on I've drafted the attached response. Do you have any comments on this / any additional arguments that I should be making?

I didn't screenshot the attempt i made at 17.11 as at that point i didn't realise it was an issue. I started walking to the car park. My last attempt was at 17:20 which was within the "10 min grace period" but 2 minutes before the ticket was given.

I just wondered if their failure in the response to no consider my representations regarding the signage not being compatible with the app. The app does let you extend time and you can extend time if you pay by machine. The restrictions that they refer to seem to be where you leave the car park and then attempt to return (e.g. if you have reached the max time for parking - which I hadn't).

Re the order that you mention - where might i be able to get a final copy of the order? Any ideas?

Merton Council have responded to my appeal. They accept that I tried to extend my time within the 10 minute grace period - and can see this from the Ringgo app logs. However they haven't addressed any of my points regarding the lack of signage about returning to the car.

Is this worth fighting or just paying the reduced amount?

Here is a copy of the Ts & Cs from the car park.

There doesn't appear to be any mention of a no-return policy other than you cannot return to the car park within 1 hour of leaving it. In this case I did not leave the car park.

Whilst it says is that a 3 hour time limit applies in other bays, I was trying to extend for a further 20 mins (on top of the existing 2 hours I had paid for).

Worth the fight?

Yes - the reasons for having to straddle the bay are set out in my representations which you can find in the Google file. The simple reasons was that there was no room on the road to repack and lots of cars were asked to move to make way for the emergency services. The road remained blocked off for the rest of the evening and I was unable to move my car. By the time I returned home the following morning, the PCN had been issued. 

I didn't receive the original notice to owner. Merton said they issued it on 14 January and sent it by first class post. I challenged this and this was accepted on 2 June where they re offered me the opportunity to settle the charge at the lower amount and reissued the Notice to Owner. This was reissued on 3 June 2025.

The first informal reps  were made on 20 September 2024. My second set of reps were made on 7 June 2025.

The rejection is dated 11 July 2025.

Me again.

This is a PCN from 2024  I have made informal representations on and also appealed via the Council. My appeal has been rejected twice by Merton.

 I now wish to make representations to the Tribunal and would appreciate your views if there are any other points that I should make.

The basic background is that my car was parked outside the bay markings. The primary reason for this is that a bus had crashed at the end of the road and the road was blocked off by the emergency services.

The road is a cul-de-sac and so there was no where else to park and no way to move my car to another road. The parking situation is already limited as 6 of the bays in the road are reserved only for pay and display vehicles.

There is also a Private Members Club on the Road and so parking is extremely limited. Anyone who was parked in the area of the bus was asked to move their cars to allow for the emergency services to attend the scene. From memory there were 3-4 police cars, 2 fire engines and 3 ambulances.

I'll see if I can get a clearer picture of the Ts & Cs - but sounds like there may be an arguable case?

The issue with Merton is that they almost always reject informal representations without any consideration and so I'm trying to weigh up whether there is any chance of fighting it.

I'll post a picture of the Ts & Cs once I have them .

No - I didn't receive any email from Ringgo to tell me that the time was almost up.

I'll need to go back and checking the parking terms and conditions, but from using that car park before I know that you can park there for the whole day i.e. its not a car park that says you can only park for a maximum of 3 hours.

I also have no idea where they publicise the "No Return" policy - but I'd need to go back to the car park to check if is obvious from the signs.

However assuming the Council has not made it clear that there is a no return policy (other than on the app when you try and extend time and can't) - would that be grounds for an appeal in itself?

My ticket was due to expire at 17.10. At 17.11 I tried to extend the time as I was delayed returning to my vehicle. Unfortunately, I got a message saying I could not extend time due to No Return Rules.

I did not realise this was an issue as you can usually extend the time via the app - so not sure what the difference is with extending the time shortly after the original ticket expired.

I managed to reach the vehicle a few minutes after the expiry time. A ticket was already on my car. It must have just been put on there as I saw the parking attendant walking away. I asked the parking attendant if there was a grace period. He said it was 10 minutes. I looked at my clock and originally thought I was in the grace period. Unfortunately the ticket was issued 12 minutes after the expiry time.

The ticket was due to expire at 17:10 and the PCN was issued at 17:22.

Copies of PCN and screenshots are attached.

Is there any point in trying to fight this?

Thank you. That's good to know. Out of interest was this Merton Council? They are usually very painful when it comes to any appeal, no matter how good the merits!

Hello

I've received a PCN from Merton Council.

I paid for a ticket via Ringgo but its picked up my old car reg that is still listed on the app.

Can I appeal this? If so on what basis?

At the very least i'd like my money back if i'm going to be charged.
