I took a family member to hospital and used the hospital carpark. Grafton Street, MRI Manchester. Operated by parking eye. We left very late at night and I paid for parking at the machine. They have an ANPR system in place. It said I owed £5. I paid this and left. The barrier opened on my exit as I had paid.
I received a penalty through the post stating I hadn't paid for parking. I found the payment on my bank statement and used Parking Eye's online appeal form. Submitting my evidence of payment.
Several weeks later I receive a letter stating I hadn't paid the correct parking amount. This was the first time I had any reason to believe I had paid less that I should have have as I simply followed the machine at the car park (the machine shows a picture of your car and your reg). I then went online to find a list of their parking charges and saw that the ANPR machine should have charged me a higher amount, either £10 or £15 depending on how long I was there. Not £5.
I then submitted an email to parking eye stating their ANPR issued the wrong amount and that I had not deliberately tried to avoid paying the correct amount, I had paid what the machine told me to pay and that I was willing to pay any difference owed in parking. I have a record of this email.
Following my email appear to Parking Eye I receive a letter from DCBL stating notice of intended legal charge for unpaid parking. I spoke with them on the phone several time again stating I did not try to avoid parking charges, the ANPR was faulty and that I would be happy to pay the correct charge.
Parking eye have now contacted the court with a potential CCJ claim. I have 14 days to respond.
Does anyone have any advice?
