Thanks for your reply, so they are right to say they posted it within 2 working days? and would i ask IAS for the proof of postage or ocean parking?

Under PoFA, the issue date is primary, because the NtK can be presumed to be delivered two working days later.

However you can ask them for proof of posting.

Hi all,

I am the registered keeper of the vehicle (V5C in my possession).

I have received a Parking Charge Notice from Ocean Parking relating to an alleged contravention at Peel Centre Stockport for “Failure to Pay for Full Duration of Stay”.

Timeline

Date of parking event: 27 December 2025
Entry time (ANPR): 14:14:50
Exit time (ANPR): 15:25:10
Issue date shown on the PCN: 31 December 2025

This was an ANPR postal PCN (no windscreen ticket)

I received the Notice to Keeper on 16 January 2026

My Appeal to Ocean Parking (as Registered Keeper)

I submitted exactly the following appeal:

I am the registered keeper of the above vehicle.

I am appealing this Parking Charge Notice on the basis that Ocean Parking has failed to comply with the requirements of Schedule 4 of the Protection of Freedoms Act 2012 (PoFA) and therefore keeper liability does not apply.

This Parking Charge Notice was issued following an ANPR event on 27 December 2025. As no Notice to Driver was placed on the vehicle, Ocean Parking was required under Paragraph 9(4) of Schedule 4 PoFA to ensure that the Notice to Keeper was delivered within 14 days beginning with the day after the parking event.

The Notice to Keeper was received on 16 January 2026, which is outside the statutory 14-day period (the latest lawful delivery date being 10 January 2026). As a result, Ocean Parking has failed to meet the mandatory conditions required to transfer liability to the registered keeper.

In accordance with PoFA, I am under no obligation to identify the driver, and I will not be doing so.

As keeper liability does not apply, I require that this Parking Charge Notice is cancelled immediately.

If you do not agree, please issue a formal Notice of Rejection together with the details required to escalate this matter to independent appeal.

I did not identify the driver.

Ocean Parking’s Rejection

They rejected the appeal stating:

“A notice sent by post is presumed to be delivered on the second working day after posting, unless the contrary is proved. The Notice to Keeper was sent on 31-12-2025. Therefore PoFA applies.”

They also stated I provided no evidence of late delivery.

My Position


My understanding is that:

Under PoFA, delivery is what matters, not the issue date

My statement of the date of receipt counts as evidence unless they can prove otherwise

They have provided no proof of posting, only an issue date

They are relying purely on the presumption of delivery


I now have the option to appeal to the IAS.


Could i please get some help with advice whether to appeal it to IAS or just accept defeat and Pay as registered keeper?
