Although the delay is lengthy, there is nothing unusual in a NtO being served before any response is received relating to an earlier informal challenge against the paper PCN.

If you look on the PCN, normally on the back, there will be something on the lines of "if a challenge is submitted against this PCN it will be considered, but if the council serve a Notice to Owner anyway, the owner must respond to the Notice to Owner". So that is what you must do or it's game over. Submit your original challenge, plus the info they asked for and point out you have received no response to your original submissions.

You could also make the point that the NtO has been served over three months sinced the alleged contravention date and is an unfair delay, which you suggest is grounds on its own for cancellation. In fact they have six months to serve a NtO, but adjudicators at London Tribunals have ruled in the past that over three months is unfair as memory fades with time, thus prejudicing your recall of events if the matter is taken to adjudication.

It may be a rejection got lost in post. There's no timeline on their site.

I would restate your case and saying you did respond to a request for evidence, but did not get another reply.

Correction from my earlier statement, it was a single yellow but during the middle of the day.  No specific loading restrictions in place (I drive an estate so people often assume I'm not loading).  I was there for long enough to be ticketed!

As I say, happy to continue the appeal on these grounds (obviously happy to take on board any input, but I've done so before with success) however I'm mainly wondering whether their skipping my appeal and moving to NtO is of any bearing.

It appears it's for parking on the double yellows, not on the pavement. Loading may be an exemption - what were you loading and how long for? Post a street view link to the location - are there any loading restrictions in force?

Good evening,

I received a PCN back in October 2025 for parking fully mounted on the (extremely wide) pavement.

The road is subject to on-street parking on one side, with double yellow lines on the side I was parked on.

Parking was due to unloading for work purposes - the premises I was visiting was directly on a corner so I assessed that the safest reasonable place to park was on the pavement, as this is probably 15ft wide with very minimal foot traffic.

I submitted an appeal based on unloading, during which they asked for proof of my work schedule for the day.

This was provided via email and they confirmed receipt (03/12), advising "Your email and any attachments will be manually uploaded to the case for review from an Officer".

I have heard nothing from them until today, when I received an NtO.  Happy to continue with my existing defence, I'm just wondering whether there are any errors on their part for ignoring my appeal and moving straight to NtO - does this open up any other options for me?
