If they don't submit the witness statement on 8th June, what is the process for submitting my witness statement to the DCB and the Court?
You might want to show us what you have so far.
If you don't receive their WS and the deadline is almost up, then you should still submit a WS on 8th to preserve your position.
-
Just in case, https://www.find-court-tribunal.service.gov.uk/courts/birmingham-civil-and-family-justice-centre for the court.
-
Do not make contact.
They are almost certainly about to discontinue but are now looking to cover their costs with a low-ball offer.

Hi,
DCB legal sent this email yesterday. I have drafted a two-pager witness statement for now. If they don't submit the witness statement on 8th June, what is the process for submitting my witness statement to the DCB and the Court?
"Afternoon
We write in relation to the above matter.
Our client is prepared to make an offer to potentially conclude this matter. We ask that you call us on 0203 838 7038 to discuss this further.
We look forward to hearing from you"
-
Your hearing date is 22 June
The claimant has to pay the fee by 12 June
You and the claimant have to submit Witness Statements by 8 June
You need to prepare your Witness Statement, but I suggest for now you research what this is and how to phrase it, and plan on its structure. A “skeleton” Witness Statement if you will.
DCB Legal has the same deadline, so I would not suggest writing a full Witness Statements until you receive theirs first, and you can use points in your Witness Statement to disagree with theirs.
It is likely they will discontinue, which may well be before 8 June, to avoid them the bother and expense of submitting their own Witness Statement. But it’s best to be prepared in case they do submit one, and then you submit yours, and then it is likely they will discontinue before having to pay the fee on 12 June.

Hi,
I have uploaded all the images of the form here https://postimg.cc/gallery/B2BfgWc
Do I need to prepare for documents from my side?
-
Can you please post the entire form, including the part where it directs when both parties are required to send documents to the court? This is one of the things we must know before giving you a good answer to your earlier question.
-
Hi ,
Added the letter image here as per the instruction. https://ibb.co/ndnQXh2
Thank you.Appreciate your help on this.

Hi,
I couldn't add the attachment while replying. How can I share the attachment in this chat?
If I click on the attachment and other options nothing shows up to add the image attachement. only shows notify/return to topic and don't use smileys option.
Please re-read my last post which contains a link to instructions for this.

Please post the letter rather than only giving us some of the information.

Hi,
Received a court hearing form and date mentioned as 12th June 11Am and claimant has to pay 27£ court fee.what are the chances of then withdrawing at this stage?
-
Your next letter will give you all of the dates, including the date by which the claimant has to pay.
-
I have received a letter from the County Court Business Centre (CCBC) stating that the case has been transferred to the Birmingham County Court.
The letter does not mention any hearing date, time, or further details.
Does this mean the claimant intends to proceed with the case in court, or is there still a possibility that the claim will be cancelled or withdrawn before the final date for fee payment?
-
Sesrch the forum.
DCB Legal will push this as far as they can, hoping that you will ignore their court claim and therefore they can claim a judgement in default. As long as you defend the claim they will likely discontinue before paying the court fee.
Loads of examples here.

Hi,
I have received the mediation call today and they offered 200£ as a settlement and I offered 0£ stating that I didn't breach the contract and the ticket was flipped without my control and said no loss for the parking company. It is unfair to charge a penalty. The mediation lady said they wanted to proceed to the court.
I said its upto them, and I offer 0£ and am ready to show the evidence to the judge. So she said the mediation status is "not settled," and it will proceed to court.
What will happen after this? Appreciate your guidance on this.
-
Search the forum for “mediation”, please, there are lots of examples.
The identity of the mediator is not important. They are not legally trained and you should not discuss your defence with them, just offer £0 as you say.
Read Section A of your N180 form.
-
Today received the mediation appointment for 20th March. Who is the mediator here?
So I should offer 0£ here if I understand correctly from the above messages.
-
I have sent that email to DCB Legal too at info@dcblegal.co.uk.
Thank you
-
A copy of your N180 should go to DCB Legal too, given they're the ones representing the parking company (whose name we still don't know)
-
Previous claim form was sent by DCB legal
So, as above, they will discontinue. In due course you will get court paperwork which defines when they have to pay the court fee, and they won’t, so you will have a date when this ends.
You should send the N180 to DCB Legal also. They are the solicitor. Why did you think not?

Thank you. I have submitted the N180 form to the dq.cnbc@justice.gov.uk and the parking company as no solicitor name was given.what will happen after this?
Whose name is on the N1SDT form you received earlier, with the Particulars of Claim? Can you post it here?

Does this relate to your ongoing case: Appeal rejected for PCN from Buckingham street car park Birmingham (https://www.ftla.uk/private-parking-tickets/appeal-rejected-for-pcn-from-buckingham-street-car-park-birmingham/msg84129/#msg84129)
No that one i haven't heard anything from them after the claim response and the case was put aside by judge.
This is the similar case of flipped ticket and i didn't appeal as they will do the same and submitted the claim response same like the last one. This time I have received this form N180.

Thank you. I have submitted the N180 form to the dq.cnbc@justice.gov.uk and the parking company as no solicitor name was given.what will happen after this?
You will get a mandatory mediation appointment, at which you will offer £0 to settle, then the case will be allocated to your local court. In the majority of cases the case will be discontinued before the payment deadline, but if not you will need to submit a Witness Statement.
If it’s the same case as above, then DCB Legal will discontinue.

Search the forum for N180 and you will find
Having received your own N180 (make sure it is not simply a copy of the claimants N180), do not use the paper form. Ignore all the other forms that came with it. you can discard those. Download your own here and fill it in on your computer. You sign it by simply typing your full name in the signature box.

Here are the answers to some of the less obvious questions:
• The name of the court is "Civil National Business Centre".
• To be completed by "Your full name" and you are the "Defendant".
• C1: "YES"
• D1: "NO". Reason: "I wish to question the Claimant about their evidence at a hearing in person and to expose omissions and any misleading or incorrect evidence or assertions.
Given the Claimant is a firm who complete cut & paste parking case paperwork for a living, having this case heard solely on papers would appear to put the Claimant at an unfair advantage, especially as they would no doubt prefer the Defendant not to have the opportunity to expose the issues in the Claimants template submissions or speak as the only true witness to events in question.."
• F1: Whichever is your nearest county court. Use this to find it: https://www.find-court-tribunal.service.gov.uk/search-option
• F3: "1".
• Sign the form by simply typing your full name for the signature.
When you have completed the form, attach it to a single email addressed to both dq.cnbc@justice.gov.uk and (email of solicitor) and CC in yourself. Make sure that the claim number is in the subject field of the email.
Just do it as soon as possible.

Hi,
I have submitted the claim response using the procedure suggested for flipped ticket parking fine and I have received small claims track N180 Questionnaire to be filled by 5th January and it was sent on 18th December. I was away for a month for vacation and the timeline was passed. Can i still submit the N180 form? how to fill this form? Please advise.
