OK, just pointing out that you don't appear to have a very strong case. You have the absolute right in law to take them all the way to London Tribunals, but have to risk the full PCN penalty.

It’s a big sign facing end away from the road and unstable with it being coveted every few seconds to which the traffic warden was happy to pose in a picture next to. See attached link.

Hi, I’m not reluctant to post the link. I’m not very good with computers at all and it was my son‘s car, not mine.
The sign is not facing the road and I believe I uploaded a picture that shows the wind blowing and the sign covering it. I’ll try not to blow this again so he can see how unstable that sign was and the fact that it was partially covered.

Frankly, I don't think you have a leg to stand on, assuming the suspension sign could be read. It is mounted correctly on the sign for the bay, and is right by your car, so saying it was not seen or coould not be read is just not credible. Sorry if this isn't what you wanted to hear, but it is reality. The bay here is subdivided into individual bays, so it is possible that the suspension was for specific bays, but the sign is unreadable looking at the photo.

There is a bay sign right at the rear of the car, and the PCN pics look to show the (massive!) parking suspension sign on this post right next to the car.  There are lots of cars parked in the road however, so it either wasn't clear or it was a very specific suspension.

Sorry, but why are you so reluctant to post a GSV link to the location. With this we can see where the signs are for the bay in relation to the position of the car.  Did your son check the sign for the bay that was nearest to the car, or did he just park and walk off ?

Thank you. I’ve posted a picture of the car at the location with the side facing the incorrect way. The sign can not been seen from the car. Would a person have to go walking around the area to find if there are restrictions? The sign is not at the bay.

Please post a GSV link to the location, telling us where the car was parked and where the sign was in relation to the car.

If one parks in a bay, one is under a duty to look for the sign for the bay to make sure you have parked in accordance with the conditions and restrictions on the sign.

Hi, thank you. I thought it was a load of rubbish. My son not home at the moment so I don’t have access to the actual PCN but I can login and get the details if this will help.
It happened in London and the sign is next to the shops away from the bay. I’ve uploaded some pictures. I’m I’m sure if you can see them or not, but you can see that the sign is a walk away from the Bay and it’s facing the opposite way that the traffic is going and it’s a one-way street.

"...it is the responsibility of the driver to ensure they have checked all signage present in the area...." is complete tosh. So how big is "the area" ? A driver parking in a marked bay is entitled to rely on the sign for the bay in which he/she parked.
You have not told us where the suspension sign was in relation to where you parked. You have also not yet posted the PCN, so please respond on these.

Hi everyone
My son parked in a suspended by which did not have clear signage. Firstly, the sign that was pointing in the wrong direction of parking meaning that the sign was pointing in the same way as what the driver would be driving forward so they would see the back of the sign. Secondly, the wind was blowing and the sign was blowing all over the place so it wasn’t clear to be seen. I made an an appeal on my son’s behalf and I sent a picture of the sign been covered up ( with the traffic warden and stand next to it) and that it was in the wrong direction so it was a unclear sign. My son has received a letter about the penalty charge notice saying that they’ve rejected in the needs to pay the 50%. However this letter has no direction of how to appeal further. It just says that if it remains unpaid in accordance with the traffic management act 2004 he would then receive a letter to say how he can formally represent himself to an independent Adjudicator.
I have power of attorney for my son duties disabilities. How do I deal with this as it’s unfair that he should have to pay for a sign that’s firstly pointed in the wrong direction and secondly the wind was blowing the sign and we have pictures of it being covered up by the wind. Even the evidence sent to us can clearly show the signs in the wrong direction but the letter says it was my son‘s responsibility to look around the whole area to ensure that he could park there correctly.
