Tribunal time.
-
I can't see any proper consideration of the issue.

Received notice of rejection. added it here https://photos.app.goo.gl/KB1SqwYVyY27LbiP9

Thanks @Hippocrates, That's a valid point. I appealed with that statement.

Try this: apologies as no time to justify the text:
The PCN
This fails to contain mandatory information at Part 2 Para. 4(8 )(v)
provided at:
https://www.legislation.gov.uk/ukla/2003/3/section/4/enacted
(v)that, if the penalty charge is not paid before the end of the 28
day period, an increased charge may be payable
This in turn refers to (iii)
(iii)that the penalty charge must be paid before the end of the
period of 28 days beginning with the date of the notice;
The following statement does not clarify this:
If after the last day of the period of 28 days beginning with the
date on which this PCN is served no such representations have been
made, and the penalty charge has not been paid fully, we may increase the
penalty charge by 50% from the full penalty charge to £240.00 and may take steps to enforce
payment of the increased charge.
In light of the above, I ask that the PCN be cancelled.

@Hippocrates, Last time I asked, you said Bexley fixed the issues on wording, does it apply all PCNs including yellow junction boxes?
-
Agree with the others, can't see any issues with the video evidence. Location is accurate.
I can't see any flaws with the PCN either but, as referred to above, Hippocrates is the expert on those.
-
Your best bet here is of someone sees something with the PCN wording or website. Member Hippo is the one.
The timing and non-vague location look OK on the PCN.
-
The video shows you driving fairly briskly into this lengthy yellow box with no hesitation whatever. The vehicle in front of you then stops leaving you insufficient room to exit the box. At the moment, I see no easy appeal argument, as you were stopped for longer than could be considered a de minimis period, but others may do so.

Hi all,
We managed to receive a yellow box PCN from Bexley council.
Sharing letter and evidence below: https://photos.app.goo.gl/KB1SqwYVyY27LbiP9
Can anyone hint how this can be appealed, any satisfactory grounds?
Thanks
