Ah, the old scam of let's accuse the driver of breaching the terms of parking without providing any evidence. I have no idea what those two photos yskrn 1 second apart on the front of the Notice to Keeper (NtK) are meant to prove.

Have you checked their website for any other evidential photos? just go as though to appeal and tell us if there are any other photos. Download them and show them here with the timestamps.

The NtK is not compliant with PoFA 9(2)(a) as there is no period of parking evidenced. Also, there is no evidence that any contract was entered into by the driver. Unless they can prove that the vehicle was parked for at least the minimum 5minute consideration period required, they have no claim. Welcome to the scam.

As any initial appeal is going to be rejected by these scammers, just follow this advice for now:

There is no legal obligation on the known keeper (the recipient of the Notice to Keeper (NtK)) to reveal the identity of the unknown driver and no inference or assumptions can be made.

The NtK is not compliant with all the requirements of PoFA which means that if the unknown driver is not identified, they cannot transfer liability for the charge from the unknown driver to the known keeper.

Use the following as your appeal. No need to embellish or remove anything from it:

I am the keeper of the vehicle and I dispute your 'parking charge'. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.

As your Notice to Keeper (NtK) does not fully comply with ALL the requirements of PoFA 2012, you are unable to hold the keeper of the vehicle liable for the charge. Partial or even substantial compliance is not sufficient. There will be no admission as to who was driving and no inference or assumptions can be drawn. Premier Park has relied on contract law allegations of breach against the driver only.

Additionally, the only photos you have chosen to show are rear shots, one second apart, that do not show the dashboard or windscreen. Those photos prove only that the car was positioned in a marked bay at that time – they do not prove the absence of a clearly displayed blue badge.

On any fair and objective view, if Premier Park had a clear, front-on image showing the dashboard with no badge on display, that is the image you would expect to see on the NtK. The fact that you instead chose to include two virtually identical rear shots suggests either no such front-on image exists or any front-on image is inconclusive or even shows a badge, and has been omitted.

The omission of any evidence to prove your assertion of a contravention undermines the weight of your evidence and you are put to strict proof of all contemporaneous images taken, including any front-on views of the windscreen and dashboard.

The registered keeper cannot be presumed or inferred to have been the driver, nor pursued under some twisted interpretation of the law of agency. Your NtK can only hold the driver liable. Premier Park have no hope at POPLA, so you are urged to save us both a complete waste of time and cancel the PCN.

When that is rejected, you can appeal to POPLA where this is most likely going to get cancelled.

Hi there again wonderful people, another lovely parking charge notice has appeared, which help would be greatly appreciated with.


Upon entering this multi-store carpark at Castle Retail Park, Radford Boulevard, Nottingham. The driver rightfully parked in a disability spot at the shop The Range and their valid blue badge was placed in the front of the vehicle on the dash, where GOV guidance says to place them. The driver then returned to the vehicle and moved the vehicle over to the BnM across the other side of the car park, another disability spot was used and therefore the driver ensured that their valid badge was clearly on the dash. They entered the store and left, no problems.

Then I, the registered keeper, received this parking charge notice on the 15/11/25 through the post. (Please see through this link: https://ibb.co/album/TKH0sk (https://ibb.co/album/TKH0sk) ) the valid badge has also been included just to prove that it is indeed a valid blue badge.
