No they haven't offered £20 only the original £100 discounted to £60 which I am not prepared to pay. 

I will attempt to speak to someone else in management tomorrow and see what they can do.

Typical ignorant fob off by the management. You should ask them who is the Monkey and who is the Organ Grinder in their contractual relationship with ParkingEye. They only needed your PC reference to get PE to cancel it.

If you're going to settle it then it doesn't matter whether you identify as the driver or not. You are accepting liability.

Nt identifying the driver only applies if you are going to fight this. There is no legal obligation on the Keeper to identify the driver to an unregulated private parking firm.

If you are happy to pay the scammers, then my work here is done.

Appreciate this advice.

When I spoke to the swimming complex they said two things. Firstly, as soon as parking hits two hours (it was 46 seconds over 2 hours) it is out of their hands as that is the maximum stay time limit and need to contact parking operator directly and secondly as the correct vehicle registration number was not entered into the system they could not find it and do anything about it  - the vehicle registered with the incorrect VRN was never there so could not see an issue on their side.

Assuming I'm happy to pay the £20, do I just restate I am the registered keeper or is there specific language I should use to refuse to name the driver?

What did the 'swimming complex' management say when you complained to them about their agent? That is Plan A.

As you have submitted an appeal, you correctly did not identify the driver. If you are happy to pay just £20, then you can respond by refusing to nae the driver as they say they are relying on PoFA to be able to hold the Keeper liable. That ignores the fact that their Notice to Keeper (NtK) is not fully compliant with ALL the requirements of PoFA, specifically para 9(2)(e)(i). However, they would disagree and it would only be a judge who could decide the point.

If you ignore and don't respond, they will simply reject the appeal and you can try your luck at POPLA. Again, unlikely to succeed. However, a POPLA decision is not binding on you and you can fight this all the way to a county court claim, where you are more likely to succeed than fail. If ParkingEye farm any claim out to DCB Legal, you will know that they do not have any confidence that they could win in court. Any claim issued by DCB Legal, as long as it is defended, will eventually be discontinued. They rely on the low-hanging fruit on the gullible tree to pay up out of ignorance and fear.

Hi,

I received a Parking Charge Notice as the registered keeper as my car was parked in Prince Regent swimming car park without a permit.

The driver had recently replaced their car and incorrectly entered the old VRN on the touch screen on the panel.

Parkingeye are now asking for who the driver was before they make a decision.

Please advise if I should provide who driver was.  My understanding is that they usually charge £20 for admin due to typing in an incorrect VRN so was surprised at the request for further info.
