The second NtK is not PoFA compliant as it was not given within the relevant period. The first one was only just and I would put them to strict proof that it was posted in time and via a first class service that guarantees a 1-2 working day delivery service. The will not have done so and will not have a proof of posting to be able to rebut a presumption of delivery within the 'relevant period'.

As you have not responded to either of these Notices to Keeper (NtK), there is little point trying to appeal them now. You can safely ignore any debt recovery letters. Debt collectors are powerless to actually do anything except to to. try and intimidate the low-hanging fruit on the gullible tree to pay up out of ignorance and fear.

Come back when you receive a Letter of Claim (LoC) which will be issued by DCB Legal (not DCBL). If you follow the advice, you won't be paying a penny to (not so) Smart Parking.

Should I email smart parking mentioning double dipping?

Ask them to show proof of the vehicle being parked on their premises?

Appreciate advise/help in responding to smart parking.

That would seem the only logical option.

Or the traffic system cameras, time and date aren't working efficiently.

To confirm mostly likely only the front half of the vehicle will have gone onto the private road.

I don't believe the whole vehicle, as the vehicle will have mostly likely been doing a three turn on Hawthorn Avenue.

So, to clarify;

On each separate date the vehicle was driven in and out of the same private road on two occasions?

As such, are we actually looking at pictures which show the vehicle entering the same road quite some time apart?

So their traffic system has seemingly detected this as one continuous visit? AKA a double dip.

How does a three point turn take 36 minutes?

Is this some kind of 'double dip' issue?

From the pictures it seems like the vehicle is travelling over the same road marking (both moving forward) - could the driver have entered the private road twice on each seperate occasion?

I don't believe their dates/times.

Photos shows of only entrance/exit.

No photo of the vehicle parked.

If the notices were triggered as you say, they will show a “period of parking” well under the minimum, for starters, but we need to see the notices please.

Hi all,

I have received 2 Notice to keeper from smart parking. 20.06.2025 & 04.07.2025.

Both times I don't believe the vehicle wasn't parked on their land.

More a case of a three point turn at the entrance to the parking, where the public pathway is.

I have received various letters/invoices from debt recovery plus saying legal actions is imminent.

Appreciate if anyone could advise how I should respond.

As I feel the invoices shouldn't have been sent to me, as parking never happened to my knowledge and they haven't provided any proof, solely an image of the vehicle at the entrance exit. 

Both times the image shows the vehicles front from the same camera angle, which would most likely prove the vehicle was being turned on the road in a three point turn, rather than parking on private land.

Appreciate your help.
