It would be useful to see photos of the signage when you get them. Sounds like this could be a case of a charge that represents fairly sharp practice, but is technically 'correctly issued'. The 5 minutes 'grace' you refer to is what the BPA call a 'consideration period' - they describe this as a period to allow the driver to consider the terms on offer and have time to leave if he rejects them. ParkingEye will argue that it is not a period of free parking and forms part of the parking time if the driver does decide to park.
I think your best bet as a first step is to go into the store and speak to the manager, especially if the driver was a customer - take a receipt if you have one.
Does the machine allow you to purchase a ticket after 6pm?

The parking at our local ASDA supermarket is free after 18:00 Monday to Saturday. The driver, who has English as a second language entered the carpark at 17:55:44, parked in a bay, went to the nearest ticket machine where there was a queue of 2 other people, read the terms and conditions while in the queue and when the person in front was trying to pay the time changed to 18:00. The driver thought they no longer needed to pay so entered the store and left the car park at 18:40:21.
The terms and conditions say that parking is free so does this come under the 5 minutes grace and should we appeal?

I do not have the photograph of the signage but will try to get there in daylight.
