Title: Re: Seeking advice – Smart Motorway speeding (58mph in 50mph zone, M62 J28–27 Westbound)

Agreed also on the course, approach it with a positive mindset and you will learn something to your benefit. Maybe a different thing to other attendees. No points now for >10 years since my course. Some people are overly cynical and negative and, yes, there can be some aspect of that but it’s a silly approach.

What did I learn? Probably that 50mph limits are everywhere and done for a reason, I may not agree with them all, but I needed to take more care than I was doing.

I'd agree, don't mess around poking the bear with a stick, it'll end in tears. Just name the driver and wait and see what happens.

I got done for 36 in a 30 the day after my mothers funeral. It was on a country B road that used to be NSL when I last used it many years ago. Signage wasn't brilliant but was there. Did my speed awareness course and actually benefitted from it, I was surprised by that.

Oh, the course was actually cheaper than a fixed penalty too but that was a couple of years ago.

Enforcement starts at limit + 10% + 2, so 57, and I have attended a speed awareness course for 57mph in a 50 limit.

The NIP clearly reached you within 14 days.

Name the driver and wait for the course offer, don’t mess around with other stuff.

If you post the driver nomination, get proof of posting from a Post Office.

Any challenge will end up in court and very likely many more hundreds of pounds than you’ll pay for the course.

Hi all,

I’ve received a Notice of Intended Prosecution from West Yorkshire Police for allegedly exceeding a variable speed limit on the M62 Westbound between Junctions 28 and 27.

Details:

Vehicle: MA23 ZHX
Offence date/time: 30/09/2025 at 22:10
Recorded speed: 58 mph
Speed limit in force: 50 mph (variable)
Device type: Automatic camera device (smart motorway)
Reference: 0133052244152220

ACTUAL LETTER UPLOADED HERE: (https://postimg.cc/ZWJjFpQY); https://postimg.cc/ZWJjFpQY (page 1)  and
(page 2) https://postimg.cc/sBzYRhSX

This seems to be at the lower end of enforcement, and I’ve not attended a speed awareness course in over three years.
Before responding, I’d appreciate some guidance on:

The likelihood of being offered a Speed Awareness Course instead of points/fine.

Whether there’s any realistic basis to challenge or mitigate this (e.g. signage, calibration, variable limit timing, etc.).

Any procedural points I should be aware of when completing the online driver admission form.

Happy to share a redacted copy of the NIP if helpful.
Many thanks in advance for any advice.
