Alright. Thanks!
-
6 months from the date of each speeding offence.
So you need to wait for 6 months from the date of each alleged offence and if you've not heard anything after a further 2 or 3 weeks you are hopefully in the clear.
-
So I come back to this forum because I am still waiting for the outcome of this.
I identified myself in November for all the charges (still inside limit)
I also received a letter that I would be notified of court hearing.
Since then there has been no contact at all.
How long does it usually take for them to book dates?
What is the time limit on my charges?
-
This is generally (at least on here and the previous forum incarnation) unheard of.
As Andy points out, the notices for various different offence dates are batched together into two different dates, with some of those dates in the second batch earlier offences than the first batch of notices. Which just makes it all the more unconventional. Usual reasons for this which you seem to have mostly ruled out are:
Moved address since issue of V5C
Recently bought the vehicle
Vehicle is leased or financed
The registered keeper of the vehicle is someone else at the same address and the OP has been named by them as the rider/driver at the time.
If none of these are a factor then there is scope to look at an out of time defence.
edit: removed unintentional bold
-
Should it say reminder anywhere in the notice? Cause it doesn't. If it is what you say a conscious intervention, is there some grounds for a defence?
No. That is why we are trying to find out whether they are simply late, reminders or "something else".
Not in and of itself. It depends on what has and has not happened - which is something we currently know very little about.
-
Marvellous.
-
Your use of American spelling is really starting to make my teeth itch.
sorry my phone auto-correct was set to that.
I have just fixed all my posts.

3. Since they wont suspend my license until I start identifying myself, would it hurt me asking for extended payment I if identified them at the end of the 20 day notice?
What is this "the 20 day notice" of which you speak?
You have apparently received 7 NIPs, all dated between 40 days and 58 days after the respective dates of offence, issued in 2 batches 8 days apart.
At first blush, if the RK receives a NIP ~6 weeks after the date of offence, the most likely explanation is that an earlier NIP was issued in time to be served within the 14 days, but apparently was never delivered, and the sausage machine generated a "reminder" when no response was received.
Or that the "RK" is not the RK - although apparently in this case, you are.
For 7 NIPs (or more) to be lost in the post, but 7 "reminders" to be delivered promptly is implausible.
For "reminders" to be issued in 2 batches, as opposed to a set period after each individual s. 172 response was due, there was IMHO likely to be a conscious intervention/override.
On the NIP I receive it says "28 days from this notice" and the date on the top is of 02/10.
Nowhere there is a August or September date.
Should it say reminder anywhere in the notice? Cause it doesn't. If it is what you say a conscious intervention, is there some grounds for a defence?
-
You say that you have not moved in over a year but the V5C is over two years old?
Sorry Im lost track of when I moved. Its over 2 years
-
What about the first NIP he received and paid the COFP without question? If that too turns out to have been late can he get the money and points back?
No (as a matter of law).

Will definitely call them tomorrow
-
... You may wish to call them tomorrow and ask why they are issuing NIP's after the 14 day requirement and see what they say...
This ^
If the OP is the RK and has been for over a year, he needs to find out if the NIPs he received more than 14 days after the alleged speeding offences were the first NIPs or were reminders.

These are the dates on the NIP document, they arrived 2 days after at least the ones from October did.
Day on V5C 26 08 23
2 days would be in the post.
Well, as far as I can tell, you have a defence to the speeding charges as the NIP's were not served in time, i.e. the '14 day rule'.
(But note the part about nominating the driver as this is a separate offence not requiring the 14 days).
Either there is something or the camera unit are 'trying it on'. (Of course, if you name the driver and just pay and take the points they aren't going to 'complain')
You may wish to call them tomorrow and ask why they are issuing NIP's after the 14 day requirement and see what they say...

What is the date after the DocRefNo. at the bottom of page 2 of your V5C?
Chronology of the NIPs and actual status:
Identified:
Offence on the 13/08 - NIP 24/09 - paid (at time I thought I had only 2 so I paid one and was going to pay the second)
Offence on the 11/08 - NIP 24/09 - Identified COFP 30/09 (was going to pay this at the end of the month as I dont have money at the moment)
Yet to Identify myself:
Offence on the 05/08 - NIP 02/10
Offence on the 07/08 - NIP 02/10
Offence on the 14/08 - NIP 02/10
Offence on the 19/08 - NIP 02/10
Offence on the 22/08 - NIP 02/10
NIP <date> is meaningless as written. Is that the date the NIP was issued (the date printed on the NIP) or the date it was delivered?
What is the date at the bottom left of page 2 of your V5C (just to the left of the barcode)?

The V5C did not change hands.
Sorry to press but when I said 'to hand' I meant fish it out...
I have it at hand yes
At the bottom of page 2 is a DOC REF date in DD MM YY format - what does it say? (This is the date the DVLA issued this V5C)

Payment isn't going to be a problem (in the short term). After you have accepted the 3rd offence, you will not be offered a Conditional Offer of a Fixed Penalty as another 3 points would cause you to tot up.
So all the following offences will see you attending court, at which you will banned for 6 months unless you can come up with a compelling exceptional hardship argument that court accepts. Court fines can sometimes paid in instalments.
Alright this is good news. I will wait to end of next week then to identify the others.
-
Did the vehicle change hands or did you move recently?
It would be unlikely in the extreme that so many NIPs were issued 'late'. (But not impossible)
Do you have the V5C to hand?
No I haven't moved in over a year.
The V5C did not change hands.

@Believe82
to further @FuzzyDucks comment.
ARE YOU the registered keeper if not who is? and are THOSE details correct on the V5.
Yes and Yes
-
I read in your website that these should come with 14 days from the offense and none of them are. (latest one that has arrived is from the 22/08)
More specifically to the Registered Keeper (RK) - thus the question above.
I am the RK and only driver of the vehicle.
Offence on the 05/08 - NIP 02/10
Offence on the 07/08 - NIP 02/10
Offence on the 14/08 - NIP 02/10
Offence on the 19/08 - NIP 02/10
Offence on the 22/08 - NIP 02/10
As all of the notifications are around 1+ month after the alleged offence it would seem you are not the RK?
I am.
Yet to Identify myself:
As an aside you have no option but to identify the driver. Failing to do so within the stipulated time will give you more issues (6 points each). And the NIP being 'late' isn't a defence to failing to nominate.
I just wanted to identify myself as late as possible to get delayed payments.
1. Are they allowed to send these NIP so far away and can I challenge them on the date alone?
As above, more detail needed. But in simple terms they are 'allowed' but their systems should not allow a NIP to be sent so 'late'. (Unless there's a very good reason to do so)
2. If I can't challenge is there a way that I can ask for extra time to pay them? Like pay once a month? Do I need to go to court to ask for that?
The timelines are fixed - there's no allowance (pre-court) for any leeway. You can obviously delay the process assuming you keep the deadlines, but it would seem this is heading to court regardless...
I see. When would this go to court? After identifying myself or paying the charges? After court can I ask for a delay of payment or some kind of monthly payment?
3. Since they wont suspend my license until I start identifying myself, would it hurt me asking for extended payment I if identified them at the end of the 20 day notice?
Once you get to 9 points and then you cannot accept any fixed penalties - the matter will be going to court. Upon hitting 12 points you will receive a totting ban of 6 months unless you can submit a successful 'Exceptional Hardship' plea.
They sent me a COFP when I am at 9 points should I wait court to pay that?
4. I commute there every day so I expect to get more from September, should I wait for them or just try to ask for delay of payment now?
If the matter heads to court then you'll want all offences heard at the same time.
OK. Ill delay as much as possible then. And identify at the end of the 20 day period.
BTW what sort of speeds/limit are we talking here?
05/08 - 38mph in 30zone
07/08 - 38mph in 30zone
11/08 - 39mph in 30zone
13/08 - 36mph in 30zone
14/08 - 47mph in 40zone (the road changes the limit on the other direction)
19/08 - 38mph in 30zone
22/08 - 37mph in 30zone
-
First question, is the name and address on the V5C correct, and was it correct at the time of the offences?
Yes they were all correct

First question, is the name and address on the V5C correct, and was it correct at the time of the offences?

I am in deep trouble and need assistance.
One of the roads I commute on has one of those big yellow cameras and I did not notice it until I started getting the speeding fines it was there (it is almost hidden by trees and it is in an area where there are many camera signs but most of the roads do not have any cameras)
I have received 6 speeding offences and now believe more are to come as I pass there every day and usually go over the limit as it safer for me.
(it is a tight road and I drive a motorcycle. It is a place with many crossings and if I speed a bit I tend to get away from crazy people trying to cut me off.)
However all these notices have come now and they are for offences in August.
If I new of the first I would have tried to find another road or slowed down.
