Please show us exactly what was submitted as his defence, and the particulars of claim that the defence are responding to.

He has already sent his defence that the claim is false.
In searching his records he found photographs of the children and ex-wife near the car park in question on the date specified. He also has evidence he was elsewhere.

What is the date of issue of the claim? Show us the Particulars of Claim (PoC).
Only your son can respond to the claim. You cannot respond on his behalf. You can do all the legwork, but it must be in his name as though he completed the defence.

So keep it simple and factual, no speculation.
If what your son received is a N1SDT form, it contains the Particulars Of Claim, and the defence is that they are false.
State, as in your first post, that your son was neither the driver nor the registered keeper of the car (the PoC probably waffles that he’s being pursued as either of them). Personally I’d leave it at that, but others may have alternative suggestions. But don’t talk about previously having driven the car, don’t talk about the possibility of having been nominated by the ex-wife. Think about anything which shows his presence elsewhere at the alleged date/time, but don’t put this in the defence.
Oh yes, probably appropriate also to state that he’s received nothing from the claimant, such as a PCN, so has not had a chance to contest it before now.

The car was registered to his ex-wife's grandmother. He drove it regularly before they separated, but this was well before the alleged event. He may have been nominated by his ex-wife.
As this is the first correspondence he has received, he doesn't know anything more.

We need to try and get to the bottom of this before we can offer much meaningful advice.
The claimant (who?) has obviously got your son's details from somewhere. What is his relationship to the vehicle?

It just feels like there’s something else here, if your son was neither registered keeper or driver then has someone nominated him as driver, or is he the keeper of a car with a similar number plate?
This seems to be fundamental to his defence, if I received a random claim like this for no reason my defence would be simply that it wasn’t me.
Whatever was received, can you please post it here?

My son has received a claim form from DCB Legal for overstaying in a car park four years ago.
He will be submitting the defence recommended in other threads.
This is the first correspondence received on this matter and he was neither the registered keeper nor the driver. Is there any benefit in adding this information to his defence, or will that just complicate matters?
