Thanks for the comments, everyone.

I believe these parking spaces fall into a bit of a grey area—almost like a fishing exercise. In my view, they lack adequate signage and clear road markings. From my perspective, I assumed that as long as I was parked within the light grey-paved area and during the correct time, I wouldn’t be liable for a PCN. This contrasts sharply with the disabled parking space nearby, which is clearly outlined with white paint. I genuinely don’t understand why the council didn’t apply the same clarity to these bays.

Unfortunately, I haven’t been able to find any resolved cases online to support my point, which is a bit disappointing.

From your professional perspective, would you recommend proceeding to the independent tribunal, or just paying the PCN while the discounted rate still applies?

It's on a strip between the carriageway and cycle lane - it could be with looking at the traffic order.

OP, IMO you do not have a statutory defence because you were parked on the footway etc. etc.

Are you the registered keeper, what was the date of their reply and why is it not their actual letter?

A bit of a money-grubbing PCN, but lawful because the car is partly outside the marked bay, which is marked with dark grey paving blocks. I show a GSV view of April 2022 which clearly shows the bay markings: -

Yet, as the OP says, there is no obstruction caused by this slight parking error. Of course, lack of obstruction is irrelevant, and the council wants your money. I don't think this PCN would be over-turned at London Tribunals, but there may be a technical appeal unrelated to the contravention. This is Hippocrates's "domain" so I defer to him on it.

I have the details and wanted to see if the council pics were available at high res so we could see better what is going on.
We can see what looks like a marked bay by the OP's car and typically for Newham this strip is adjacent to a double yellow.

Maps shows that bay is an m/c bay and then there is what seems to be an unmarked but signed shared use parking bay, and then a disabled bay.

The PCN was a Sunday when the bay is unrestricted apart from event days.

It seems to be a contravention because the OP's car is not in line with the marked bays but there is no marked bay for the general parking bay.

Hi all,

I’ve been issued a Penalty Charge Notice (PCN) by Newham Council under Contravention Code 62.

I submitted an appeal to the council, which was unfortunately rejected. I’m now considering whether to proceed with an appeal to the independent tribunal and would appreciate your advice.

In my initial appeal, I provided the following rationale:

- I parked during the permitted time.

- There were no clear markings on the ground indicating a designated parking space.

- I did not obstruct pedestrian access to the footpath or cyclist access to the cycle lane.

- I attempted to park as close as possible to the vehicle in front, but a light pole behind me required me to reposition my car.

- Another vehicle parked outside the grey brick area did not receive a PCN.

I’ve attached the council’s rejection letter (copied into Word), along with the photograph they took on the day, a video I recorded at the time, and a screenshot from Google Maps.

I genuinely want to understand whether I was at fault. If so, I’m willing to pay the fine. However, if there’s a valid basis to challenge this further, I’d appreciate any guidance or support.
