This challenge has unfortunatley been rejected.
But due to working away from home I have only just been made aware of this, 6 days past the 28 day response date.

In a bit of a panic I have submitted an apeal to the londonTribunal online today (1st December), citing the same information I used for the challenge against the PCN. I did this in an attempt to stop the council increasing the charge to £240

I dont know at this stage if my Tribunal appeal will be heards due to the late submission. But will updat when I do.

I make this collateral challenge as follows:

Mandatory information is missing as provided at Para. 4 (8 ) (v) of

https://www.legislation.gov.uk/ukla/2003/3/section/4/enacted

(v) that, if the penalty charge is not paid before the end of the 28 day period, an increased charge may be payable;

Clearly, this refers to Para. 4 (8 ) (iii):

(iii)that the penalty charge must be paid before the end of the period of 28 days beginning with the date of the notice;

Therefore, the PCN lacks clarity.

Also, there is an incorrect ground appearing on the PCN re the Traffic Order being invalid which also nullifies the PCN.

Finally, I was impeded by the  black car in front of me to clear into the space ahead and  the video does not show the situation directly in front of me and beyond the YBJ when I entered.

Therefore, in light of the above, please cancel.

Technical but worth a try. Back tomorrow with this. That black car impeded you as you would think it was going into the right hand part of the road. Also, the video does not show the situation directly in front of you when you entered. Others will have their views on this point.

Hi,

I am seeking some assistance and guidance regarding the PCN from the London borough of Havering for an alleged traffic contravention 31J: entering and stopping in a box junction when prohibited.

The alleged contravention happened on the 9th July, and the notice was issued on 30th July which I received today having been away for 4 days on a short honeymoon.

I am hoping that as per the link below the PNC can be dismissed on a technicality with reference to "inappropriate grounds appearing on the PCN"

I am not contending the offence per se for as you can see from the video, I entered the yellow box with a vehicle in front of me. This is durring the Gallows Tree Corner closure, which is causing havoc with traffic in the area. And it was proving extremely difficult to proceed along this road as the traffic from the left was constanly pulling into any space created outside of the yellow box junction. In normal circumstances this junction functions fine with occassional traffic puling out from the left.
