You have't stated why you were not served with the claim. You have shown the original NtK. Did you change address at some point after receiving the NtK? How long after receiving the NtK did you move? Did you appeal or respond to the NtK as any point?
You will need to explain what you are applying for a set aside under CPR 13.2. CPR 13.2 is a mandatory set aside but you need to show why it must be given. You need to explain that the claimant failed to carry out any required checks to see if the address for service that held was still valid, especially if they did not receive any response to the PCN, reminders, debt recovery letters or the LoC.
Also, if the claim was not served within 4 months of the date it was issued, the claim is dead and should be struck out and you will need to include that in the N244 application, otherwise it will only be set aside and the claimant will be able to continue with the claim.

Call them, preferably first thing in the morning to arrange payment. Can you show us, suitably redacted, your application, Witness Statement and draft order?
-
Not as of yet, I have emailed the court with the reference number, stating that I was unaware of the original claim and that I have the documents ready to go but I couldn't find a way to pay the fee and submit so I'm waiting to hear back from them.
Thank you for replying.

How have you submitted the set side application? Did you complete an N244 and also submit a witness statement and draft order? It costs £313 to apply for a set aside but if the claim was never properly served, then is it a compulsory set aside under CPR 13.2.

Good Afternoon,
I am hoping someone can help me out as I am feeling very broken right now! Please bear with me.
I have discovered that I have 2x CCJ's against me for parking tickets issued at the Marine Hotel.
I am the registered keeper of the vehicle but not the driver of it, the driver stays at the Marine Hotel regularly.
The vehicle was registered to an address I used to live at on & off and over a period of 18 months, it would seem that the other resident of the property has been throwing a lot of my mail in the bin.
I have found an ungodly amount of unopened (hidden) mail over the weekend that I have been working through and when I found a large number of letters regarding my vehicle, I ran a credit check fearing the worst. As above, I have 2 very recent CCJs to my name.
I have spoken to the court and once I had the details, I applied today to have these set aside due to me not being notified of the claim and I'm waiting to hear back if the case will be heard again.
Amongst the many other things going on in my life and not needing all the added stress, I have paid 6x other tickets with this company today to stop them proceeding to court as I cannot reliably secure my mail. I have changed the registered address of the vehicle so that going forward this won't happen again.
--------------
The hotel is on a seafront and has a permit controlled car park to prevent non-customers using it when the seafront is busy. Previously, when staying there, the driver would enter their registration onto a tablet at the hotel reception desk (the staff always reminded them) and enter how many days they were staying for. The car park is open to the road but has ANPR cameras facing the entrance.
Because the desk isn't always manned, the hotel changed the method of obtaining a permit to scanning a QR code in the rooms of the hotel to prevent random members of the public wandering into the reception and entering their registration for the day. This caused loads of issues at the hotel with fines galore and the hotel (after about 1 yr), changed the method of obtaining a permit back to a tablet on the desk.
Previously, if the driver obtained a ticket for not obtaining a permit, the hotel would engage with the parking company and instruct them to cancel it, especially given the number of issues they were having.
Would someone please be able to review the tickets below and let me know if there's a defence I can use if the claim is heard again?
I am missing a number of letters from each PCN, it appears these have been binned.
I have been completely unable to appeal or speak to anyone regarding any of these fines as I only just discovered them today. They have pursued me as the keeper, with no knowledge of the driver's identity.
I cannot even get Civil Enforcement on the phone, it's entirely automated. DCBL have advised they are no longer involved, it has been passed back to Civil Enforcement.
