Agree.

But knowing what's a statutory defence and what's a plea for discretion must help set the tone of reps.

OK, but best not to dive in all confrontational. Just submit reps on what you've told us, and emphasise they set up an Autpay account, but didn't realise it didn't cover previous crossings before the date the account is set up.

yes it's there if you look for it but if you google "pay the blackwall tunnel charge"
you get

this (https://tfl.gov.uk/modes/driving/silvertown-blackwall-tunnels-charge/paying-blackwall-and-silvertown-tunnel-charges)

scroll to "how to pay"

no warning

Yes there is:

Auto Pay covers your payments from the moment you set it up, as well as payments for trips made earlier on the same day. Any trip you make inside charging zones or through Blackwall or Silvertown tunnel on the day before you set up will not be covered by Auto Pay. You'll need to pay these charges separately.

hey Stamf. the issue for me is that when you access tfl site for how to pay its heavily weighted to set up auto pay but there in no warning it won't cover a crossing the day before that you are trying to pay. it should initially direct you to online or phone payment.
in this case the auto pay was within the 3 day period.

You can't set up autopay retrospectively (or at least you couldn't). If it's not set up you need to pay and set it up for future trips.

This case suggests they may cancel but it may have been because they have been applying grace for the new tolls:

This case suggests the grace may be over:

Helping an elderly friend.
They went through tunnel southbound in morning and northbound in afternoon. both on 22/6

they tried to pay online next day. Tfl website offers Auto pay, online or phone. Blatant pushing towards Auto Pay.
They are likely to use tunnel frequently so opted for Auto pay, especially as they live in a discount option borough. Opened account and got confirmation from Tfl within the 3vday payment window.
Yesterday, the 5th received PCN for non payment of northbound crossing. (the 2nd if the day)
PCN dated 28th. 7 days after issue date.

Is there an avenue for appeal?
