We only need to see a Letter of Claim.
-
Got another one of these. They still aren't getting as far as a Letter of Claim.
They seem to be just repeating themselves. Possibly in the hope that I will get scared?

I got another one of these today.
They still seem to be sending me debt recovery letters and there's been no Letter of Claim yet.

They like their red ink, don’t they?
Hehe. Yeah. The red capital letters on "IMMINENT" made me chuckle when I saw it. I think it was because they're pulling out all the stops to try and make the recipient worry.
-
I've had another letter. It looks more or less to be the same as last time, except the wording is more hurried.
Still no Letter of Claim, though. I will wait for one of those.
Good.

Thanks for both replies. Makes sense. I will wait for further correspondence.

An LoC will tell you that it is a letter of claim or before claim r something on the lines. It will NOT be for the useless DRP as they are not a party to the contract allegedly breached by the driver.
A real LoC will come from wither the operator themselves arm, more likely, from a bulk litigator such as DCB Legal, BW Legal, Moorfields, Gladstones, et al. You will know it is a real LoC because they are obliged to give you 30 days to pay, not the usual 14 days that the bottom0dwelling debt collectors give.
-
Correct, whatever it’s called it’s still from Debt Recovery Plus, whom you should continue to ignore.
-
Bump.
I got another letter relating to this, today. I've uploaded two files. One is similar to the previous debt recovery letter, but a bit more stern. The other is something they are calling a "terminal notice". This is not the same as a Letter of Claim, is it? I still haven't replied to any of their letters. Should I carry on not replying until I get a Letter of Claim?
Cheers.

Ah, right. If I post any more documents I will timings in but, like you say, I'll just leave it for now. That bit you quoted is a great example of how this business seems to operate on an flagrantly unfair basis, yep.

Obscuring times is generally unhelpful here and https://www.ftla.uk/private-parking-tickets/read-this-first-private-parking-charges-forum-guide/ specifically asks that you don’t, however in this case it doesn’t matter because the PCN is so bad.
“This incident happened in the period of time immediately preceding ….” is not a “period of time” as required by PoFA if they were using its provisions.
-
Thank you. I also noted that there is only one time one the PCN (which I have blanked out). If they had included an entry time and an exit time then the driver is of the opinion that entry/exit time would be exactly the same. I will wait out for the Letter of Claim and not reply to them, as you say. When I get some more info I will post back here. Thanks again.
-
Laughable, really.
The driver didn’t remain long enough to enter into a contract, which would have required examination of the terms and conditions on the signs, and the PCN does not comply with the requirements of PoFA 2012 to transfer “liability” to the registered keeper anyway - no period of parking specified to name but one failure.
Too late to appeal now, so you just need to ignore all the debt collector rubbish and wait for a Letter of Claim in due course, and then come back here for advice. It’s quite possible it will come from “Moorside Legal”.
Just don’t identify the driver, as you haven’t done.
Note that they’re not pretending their PCN meets the requirements of PoFA 2012 anyway.
I wonder what percentage of their victims just pay up on receipt of this unenforceable nonsense?
-
Hi. This was recieved today, following two initial PCN's.
I've included all three. I am the registered keeper. I have been informed that the driver simply turned around and did a 180 in the car park, so they were barely even stationary for more than maybe 5 seconds before exiting. The driver thinks that it was also dark as was some time after 9pm. The pictures which I blanked out certainly look like the driver is right in it being dark. They are barely legible. The car park is more like a piece of wasteground than anywhere a driver might have liked to park a car. This seems really scammy and I don't want to pay it.
