Hi Guys,

So i paid the first one, edited my "challenge" to the other 3 explaining i am paying the first one in good faith with mitigation on the 3 remaining that if i would have received the first one in good time i would not of used the Tunnel for the other 3. They have refused it and are asking for payment for all. If i write to the tribunal do you think i have a chance? Thanks again for your help
Please post your reps and their reply.  There may be a 'technical' appeal, but aFAIK, only our administrator cp8759 knows about this, so wait until he responds, but don't miss the deadline to pay or register an appeal at London Tribunals.

Ahh, great. I'll pay the first one and have a go at appealing the other 3. I will of course keep you posted with the result for future reference for others.

Thank you so much.

This is the essence - the below is by Tower Hamlets but is what we hope all authorities should consider.

Thanks so much for the prompt reply.

ok great, so, do you think if i pay the first one and appeal on the other 3 on the basis that if i'd have received the first one before i got the others i obviously wouldn't have used the tunnel i may have a chance ? if so, do you know if i can i go back on the portal and edit the appeals or am i too late?

Thanks for your help in this.

Best Regards
Geoff

I expect you only became aware of the contravention when PCN 1 turned up. The other three will no doubt be dated after PCN 1 but before the date PCN 1 arrived. So you should submit representations on the basis that you were unaware of exceeding the weight limit until PCN 1 dated <date> arrived on <date>. You therefore request that PCNs 2-4 be cancelled on the basis of it being a disproportionate penalty. Cases like this are very difficult to appeal against.

So far, the adjudicators seem to agree with TfL that the signage is adequate, so it looks as if you will definitely need to pay PCN 1 at the discount rate.

Hi Guys

I had to hire a van to help my daughter move house, hired a van and went through the Rotherhithe Tunnel on the way there and back on 2 seperate days. now in possesion of 4 x pcn's for weight contravention. As you probably know, the entrance is always chaotic on the way into the tunnel from both sides, i genuinely didnt realise there was a weight restrictions for a normal transit van now. The van was empty on all occasions but is over the 2 tonne limit. However, i think the signage is too confusing when having to handle the traffic and entrance through the skinny bollards on the way in. I honestly thought if the vehicle was slim enough and short enough to get through the bollards and height restriction poles hanging down then we're good to go. I have appealed on all 4 pcn's but would like to know if anybody has appealed this before and been successful and if i have a chance to get out of this mess, otherwise its going to cost me the best part of £700. Many Thanks.
