The requirements of s. 1 RTOA 1988 (to give a warning or serve a NIP) are deemed to have been complied with unless the contrary is proven.

Unless you have (or can obtain) evidence that the initial NIP to the RK was delivered outwith the 14 days, the straws you are grasping at are further from your reach than you thought.

Don't know what she means by that. The police must serve a NIP on the Registered Keeper within 14 days of the date of the offence. It is deemed "served" two working days after posting.

Are you sure that the lease company is the RK? There may be a finance company who is, so that would mean the first NIP (the only one required by law and so the only one subject to the 14 day rule) would have gone to them.

If the lease company won't give you any details you could ask the police what date the first NIP was sent.

Afternoon all

i was spotted by our mobile camera friends doing 24 in a 20 in my works vehicle on 16/04. I received the NIP addressed to myself on 16/05. Im aware our lease company will have identified me as driver, which is why iv copped for the NIP - no arguments there.

My query is about the window of delivery. I believe the window is 14 days to the RK, but my lease company are less than forthcoming with any information about when it was received. Is there anything i can say to them to help provide any info? If RK received NIP after 30/04, would this void the window of delivery? Girl on the phone kept saying '28 days to the RK so it wouldnt help you' but wouldnt give me the date it was received, so my knowledge is conflicting.

Or is it a case of taking my medicine and hoping for a SAC?
