So find out who does own the car park. If this car park is shared with other businesses or retail outlets, there is usually an advertising plinth which often has the landowners management company details on it. Or try auntie Google.
-
The gym just replied:
I'm sorry to hear that you received parking fines. I'm afraid that we do not own the car park and are not responsible for issuing fines. If you did get a fine, this would not be due to our decision.
There should be an appeals process that you can follow. It typically involves contacting the parking company and providing a screenshot that shows that you were in the gym on the date of the offence. This information can be found in the app under the activity tab.

This is what I sent to the gym
Hello, I have 3 parking notice letters from group nexus and dcbl that are trying to charge me £170 per ticket.
I forgot to verify my parking but I am entitled to park and didn't breach the terms of parking.
I have the dates and times in my app to prove I was in the gym at these times.
Please are you able to help with issue as I pay for membership and Its excessive and extortionate to have to pay £510 for something I'm entitled to.
-
I'd missed that point.
Show us the exact wording of your comms with the parking company @Dcblsucks
As others have said, don't contact the debt collector. What do you even hope to 'put on hold' at this stage? The sooner the PPC issues court papers, the sooner you can defeat them and move on.
Right now there is little more that you can do. Aside from answer the questions above so the forum can help more effectively when the time comes. Additionally:
What steps have you taken to get the landowner to insist the PPC cancel the PCN?
Have you completed the DRN to ensure all future correspondence go to the correct address?
-
OP, let's be clear pl.
You posted: I tried to reach out to group nexus who sent the original pcn but they said it was too late even though I showed proof that I was entitled to park there.
Which to me means that you acknowledged that you were driving. Is this correct?
If so, then the NTKs' compliance with PoFA is redundant because the driver incurred the charges and they know the name and serviceable address of the driver.
I don't follow: 'As I have moved out from my mums and haven't got around to changing my address I missed the original pcns'. So if your mum was still there why weren't they simply forwarded to you?
-
Do not make any contact with DCBL. They are powerless to do anything. Ignore DCBL unless you are low-hanging fruit on the gullible tree unless you believe they can make you pay out of ignorance and fear.
-
I can't find the original, and the gym haven't replied to my email for help on this.
Do I need to contact the dcbl to put this on hold?
-
That’s not the original. That is the reminder. If you are going to show the NtK, leave ALL dates and times un-redacted!
-
This is the initial ntk the date of issue was 30th of december

It’s unlikely that the gym has absolutely no power to get a wrongly PCN cancelled.
You'd be surprised - I've seen some ridiculous contracts that businesses have signed up to. That said, this seems to be a fairly large business who (a) are likely to have someone legally competent in head office making sure they don't sign any crap contracts and (b) have more negotiating power than a small firm.
Being persistent with the gym is definitely a good idea.
-
It’s unlikely that the gym has absolutely no power to get a wrongly PCN cancelled. Don’t take no for an answer. Ask them to justify their support for an unregulated parking company hounding their paying customer to pay an unreasonable charge.
As an aside, get out of your head that these are ‘fines’. They are simply speculative invoices from scammers.
Have you sent the DRN as instructed by b789? Can you post the NtK?
-
You can't appeal to POPLA, too late for that.
-
Thanks everyone it says on the gym site they do not get involved and have no say for any parking fines. But I have still emailed them just in case. Is it worth creating an appeal with POPlA?
-
As above. Your plan A is to get the gym to call of their contracted dogs. If you're now receiving debt recovery letters, it is too late to appeal. Your fault for not updating your V5C.
Even if you have since updated your V5C, that makes no difference. You must send the parking operator DPO a Data Rectification Notice (DRN) instructing them to update their records with your current address for service and to erase your ol address. The highlighted words are there for a reason, so use them.
Failing to do that is a surefire way to get a CCJ by default.
We are not interested in any debt recovery letters from powerless and useless debt collectors. Never, ever, communicate with a debt collector. They are not a party to any contract allegedly breach by the driver. You can safely ignore them. Their only job is to try and scare the low-hanging fruit on the gullible tree into paying out of ignorance and fear. Ignore them.
Please show us at least one of the Notices to Keeper (NtK) you received. Do not redact any dates other than times.
-
Your first port of call would be the gym to call the hounds off.
They will almost certainly raise a claim for the monies as that's how they roll. (Remember it's not the gym suing but a parking company that only makes money from issuing PCN's)
-
It seems on 3 occasions I have forgot to validate my parking at the gym. I am entitled to park there and have proof in the app that I was attending the gym at the times in the letters.
As I have moved out from my mums and haven't got around to changing my address I missed the original pcns now I have 3 letters from dcbl and they say its too late to appeal.
I tried to reach out to group nexus who sent the original pcn but they said it was too late even though I showed proof that I was entitled to park there.
I have one letter with a date of 18th of march with 2 fees coming to £340 and another dated the 5th of March.
Am I able to fight this, surely they can't make me pay if I pay for this service.
