In this occasion, I think it may be better for the driver to accept the fine.

Absolute rubbish! It is not a "fine". It is simply a speculative invoice from an unregulated private parking company for an alleged breach of contract by the driver. Does the driver simply accept any old invoice from anyone and just pays it because it is an invoice?

In fact, if the driver simply does nothing, ignores all the useless debt collector demands and just waits for the inevitable court claim and then defends it with our advice and assistance, they will never pay a any to ECP as they will eventually discontinue.

Anyone here, receiving our advice and following it, never has to pay ECP a penny.

The driver can fight it or simply give in and pay the scammers and become a part of the problem. This is how these unregulated private parking companies operate. They rely on the low-hanging fruit on the gullible tree to pay up out of ignorance and fear.

Your time and money, your call, but if you are up for a fight there's a very strong chance you can beat them.

Whose website did they fill out a contact form? ECP or the landowner/agent?

Has the Keeper, at any point, identified as the driver?

No one who is here receiving advice and follows it, pays a penny to ECP. However, it is going to be a long process and will most likely end up as a debt claim in the county court. The main point is that it will never get as far as a hearing and the claim will eventually be discontinued.

The only thing that must be done, is to follow our advice. We will provide a hand holding service throughout the process, including providing a suitable defence for the eventual claim.

There will be a period when the Keeper receives a load of useless Debt Recovery Agent (DRA) letters. These can be safely ignored and we really don't need to know about them and the Keeper should just shred them and use the as hamster bedding or whatever.

The DRA letters will seem scary but they are powerless to actually do anything as they are not a party to the contract allegedly breached by the driver. They rely on the low-hanging fruit on the gullible tree to pay up out of ignorance and fear. Simply ignore any DRA letters and never, ever, ever communicate with a useless, powerless DRA.

So, do you want to challenge this Parking Charge Notice (PCN)?

Hi, please go easy, as the driver has a few health issues, which have caused a lot of stress and distraction lately.
The driver parked at a car park, staying in a hotel overnight. In their haste, the driver did not check if they had to pay on entry.
When the driver spoke to one of their party the following morning who had also parked there, they then found out it was a pay on entry.
The driver then tried to pay online and over the phone, but was unable to backdate.
The driver then tried to ring the car park owners, but being a Sunday they were unable to get through. Then they filled out a contact form on the website. The driver did not receive a response.
The driver then received a PCN.
The error is purely down to the driver for not reading the signage, but as they tried to rectify, is it worth appealing?
