Title: Re: Ealing - 47J stopped on a restricted bus stop/ stand
Post by: Incandescent on January 26, 2025, 01:21:19 am
@Incandescent - thanks I've had a look at the council website and it only offers general representation at this informal stage. Does the statutory grounds come in after this?

I submitted all the PCN pages in the imgur link. Thank you for your input.

@stamfordman - thanks for raising that similar case. I believe this stand has the no stopping sign in the middle so I doubt that I can use the defence that it was difficult to see from where I was as I had stopped past it.
Can you post a screen shot.  Our Hippocrates is much more up-to-speed than I am on council web pages for submitting reps. We've had a few wins on here due to their unlawful content.

We've had another recent case on this. PHVs are not exempt from stopping on yellow bus stop clearways or red route bus stop clearways, but licensed Hackney Carriages - ie black cabs - are exempt but only on yellow bus stop clearways.

Well, unfortunately your impression is wrong. Only buses can stop at these restricted bus stops. There will be a sign stating this somewhere along the bus stop: -

Looks like the little neds have been at this one, but the message is still clear.

However, this doesn't mean it's now game over, because the council management of the enforcement process may be in error at some stage. As a start, go onto their website and look at the pages for submitting representations. The statutory grounds for an appeal should all be there; are they ? As for the PCN, can you please post all pages, please so we can check it for fatal errors.

Hi all,

I've received a PCN for Stopping at a bus stop. I'm a private hire driver and the rider wanted to be picked up from Ealing broadway. What are my options moving forward and what should I tell Ealing council in my representation to them. I was under the impression I could stop there to pick up and drop off passengers similar to bus lanes.

I've added the communications I've received from the council and a recording of the alleged infraction.

The videos are in wrong sequence as I had to chop it to meet imgur requirements.
