Not interested in reminders or debt collector letters. The only document that is relevant is the original Notice to Keeper (NtK).

Under no circumstances reveal who was driving. You are only communicating as the Registered Keeper. They have no idea who the driver is unless you tell them. You are under no legal obligation to identify the driver to an unregulated private parking company.

The first thing you need to do is send a Data Rectification Notice to the DPO at ECP instructing them to change your address for service to your current Scottish address and for them to erase your old address. If your V5C is now updated, you can send them a copy of that as your proof of address. If not, just send a utility bill with your current Scottish address on it.

Once that is done, you can ignore everything else from ECP or their debt collectors. There is no Keeper liability in Scotland, for now. They will not pursue a claim under the simple procedure in the Scottish courts. It is just not worth their while.

Eventually, they will give up. However, you must get them to update their records and to erase your old address.

I should add I'm almost certain signs in the car park mention a 15 min grace period to use the local businesses but I can't find the terms on their website.

Hello,
I (as the registered keeper) have recently received a letter from ECP informing me of a parking charge for parking for 23 minutes. After entering the car park, the driver drove around for about 10 minutes to find a space, before parking and collecting a takeaway from one of the nearby restaurants within the car park. The issue is that the letter has been sent to the keeper's old address - my parents' in England (which I have since updated with DVLA to the new address in Scotland). Additionally, the second letter is dated 15/11 but only arrived today 25/11. I do not know when exactly the first letter arrived as I was only made aware of either of them today.


Any advice would be greatly appreciated, and I certainly understand it was silly to not update the registered keeper address immediately, although I thought I had.
