Hello Everyone,
I have a NIP for speeding across one of the dreaded traffic lights that uses the red light camera as a speed camera ( 3 white lines across the junction)
49mph in a 40mph zone - A127 Southend.
No photographic evidence was provided with the NIP. I am unsure if I was doing the alleged speed although 49mph is not fast on a dual carriageway.
I assume I will have to respond to the NIP but can I request/demand sight of the photographic evidence that would have been used to calculate my alleged speed ?

You can demand the evidence, but you won't get it at this stage. What you can do is ask politely for any photos "to help identify the driver" Don't mention "evidence". The police will usually oblige. If they do, post the photos here for advice.
Meanwhile, asking for photos doesn't stop the clock: you still have to name the driver within the 28 days.
