The pay machine is not out of order - councils are decommissioning the pay machines to switch exclusively to pay by phone methods but this is partly due to the machines running on 3G networks, which mobile networks are turning off.

10 minutes is the grace period after paid parking expires so doesn't apply.

What time did he arrive and why didn't he buy a session as soon as the phone was booted from the charger. No visitor permits?

Hi, my brother got a ticket because he didn't pay for parking.  His phone was dead so he couldn't use the app or call up and the machine was out of order - so he couldn't pay with his card for parking. 

The parking attendant only observed for one minute - my brother thought he had 10 mins grace.

Because he thought he had 10 mins he asked his friend to charge his phone so he could pay for parking, when he came out he had a ticket on the car.

Does he have any grounds for appeal?

I have attached a picture of the pcn and also the machine which says its out of order.
