Title: Re: Unpaid FPN - Magistrates court hearing soon - advice please
Post by: The Rookie on July 20, 2024, 06:48:22 am
Ok so am I supposed to attend the court hearing alone and represent myself as I can’t afford private solicitor fees even though the council have summoned me to the magistrates and are trying to prosecute me for allegedly idling which I was not.

An enforcement officer pulled over in front of me couple months ago in a Parked bay got out his unmarked dinger and about 1 min later and came to my window. He said he’s an enforcement officer and was demanding I give him my drivers licence. He did not present his id to me. He told me that he’s recording me on his body cam. I didn’t not interact or speak to him, I drove off straight away. In his witness statement he lied saying he was 2m from me and he was there for 5 mins. He was 20cm from me and the interaction lasted no longer than 20-30 seconds.
I requested the footage the council refused to send it to me unless I provide them with my ID which I will not be doing. They have also not included it in any of the exhibits of evidence in the summons.
They are trying to take me to court for refusing to comply with an enforcement officer and for idling apparently. When issued two fpns I refused to pay as I’m not guilty of either criminal offence. The enforcement officer did not identify himself, was in an unmarked vehicle and in plain clothing and I was not idling my car. So what can I expect in court?
Yes, you are expected to defend yourself.

You say you were not idling, so what were you the car doing and what would make him believe you were idling the car unnecessarily?

They aren’t trying to take you to court, they clearly are.

If you didn’t ask for ID and merely drove off that doesn’t help your cause…

You're not going to get legal aid for anything where a custodial sentence is not a possibility.

Doris Stokes, Mystic Meg and all the other mediums, psychics and assorted con artists that we used to rely on have mysteriously died. If you want advice on defending the charges, you might want to flesh out the details somewhat.

Hello all, I am seeking some advice on a now serious matter. I was issued two FPNS by a west London borough - first was £250 for refusing to comply with an enforcement officer (when he approached me I drove away within 10 seconds (did not interact with him as I felt threatened) and second was £150 for ‘idling’ my vehicle on a public road. I refused to pay the fpn fine. Now they sent me a single justice procedures court summon, I responded not guilty by post and they sent back a magistrates court hearing and the date is very soon. I have already a written statement and have all the relevant information and evidence. I am currently unemployed and would like legal representation at the court hearing and legal aid to cover this. Could anyone recommend any law firms or anywhere I can apply for this please and any other general advice is much appreciated.
