It means they’ve already taken it to court and they will enter a judgment against you unless you file the relevant documents with the court disputing the charge within the time limits specified in the paperwork you received from the court. I’m going to send you a direct message - please reply
-
I've received a 'CLAIM FORM' for this PCN. Comes with court fees, legal representative costs and amount claimed charges. Does this mean they're taking it to court and what can be done?

Is there any grounds of appeal?
It'll be too late to appeal - it's essentially a choice of pay, or tough it out and see if they choose to take the matter to court. Hard to say if you have a defence based on the info provided so far.
Can we see what's come back from the SAR?
-
Hi,
So I have received the requested from above. It seems this day was the day I was travelling towards Manchester from London and I had made a stop off here for some rest in the vehicle.
Is there any grounds of appeal?

Ultimately it's your call what information you provide, it's your data after all, but some considerations...
Group Nexus do need to verify that you are who you say you are, so that they don't wrongly hand out someone's personal data. In theory the way they do that is by comparing the data you send them with the data they have on file (i.e. name and address). Given that they don't currently have your date of birth, it's not clear how you providing it to them helps them to verify that you are the data subject in question, so it would seem they shouldn't be asking for it (there's some guidance on this HERE (https://ico.org.uk/for-organisations/uk-gdpr-guidance-and-resources/individual-rights/right-of-access/what-should-we-consider-when-responding-to-a-request/#ID) - as an aside you might want to let the ICO know that Group Nexus are requesting unnecessary personal data before complying with SARs).
That said, if they're being stubborn and it gets in the way of you getting a response to your SAR, which is the main aim, then you may decide to provide some of the data. Be careful that none of what they are requesting could harm your case (if they are asking who was driving on the form, for example, this definitely shouldn't be provided).
-
;D I meant information on my birth date ect.
-
' I am not willing to provide personal identification but here is evidence of my identity attached to this email ' ?
'I'm not willing to do what I'm telling you I'm doing'?
That's just daft!
-
" Please Note: If you do not supply all of the above information we will not be able supply you with the SAR
information you have requested. Once this information is submitted we can then process your request in a timely
fashion. We have 30 days to return the information we hold about you. The 30 days will start when we have
validated your request. "
This is quoted on the form they have emailed me.
Shall I email two bills providing proof of identity and start the email as
' I am not willing to provide personal identification but here is evidence of my identity attached to this email ' ?
Also the form they have provided asks for personal details such as DOB, shall I also mention I am not willing to provide these personal details?

As a minor point, the V5C proves you are/were the Registered Keeper, it doesn't prove ownership (and actually says 'This is not proof of ownership' on the front). There isn't a register of owners in the way there is with keepers.
As I noted earlier - ownership isn't necessarily relevant to the matter.
-
I don't have proof of ownership. I will forward to documents to prove identity today
-
The issue at this stage is getting a copy of the documents that have gone missing - giving them 'an earful' is unlikely to help with that.
If you're able to provide proof you were the registered keeper at the time then do so. Otherwise send 2 documents to prove your identity (don't send any photo ID!).

I don't mind giving them a earful as that clearly is right. They obviously know I was the owner at the time.
Shall I send my ID and proceed with what was said above?
-
It always annoys me somewhat that some companies insist on proof that you are (or were) the Registered Keeper - they already have that info, the DVLA provided it to them in order to issue the Parking Charge in the first place! Verification of your identity should be enough (although pragmatically, if they want proof that you were the registered keeper, providing it might be the quickest way to get the info you need).
-
I haven't sent off anything yet as they're requiring proof of ownership at the time which I need to obtain from DVLA on Monday.
It isn't a form sorry, it's proof of my identity which is utility bill and ownership proof.
-
There shouldn't be a form required in order to gain a response to a SAR, so I'm not sure what you've filled in.
Hopefully no unnecessary details such as phone number etc.
-
I'd have to wait on the exact location of this.. as far as I am aware from a google search - it looks like this is a motorway service point which is near to Manchester which is no where near me..
They've replied and I've filled in the form they requested, i'll be back once they've sent details
-
There's not an awful lot of advice that can be offered until you get the information back from the SAR(s). In the meantime if you're near to the car parks in question it may be wise to acquire photos of the signage and the layout of the car parks.
-
Oh wow, sorry. I googled it and came to that email.
Appreciated

I've sent an email for the subject data access to subject.access@nexus.org.uk
That's the email address for the Tyne & Wear Transport provider Nexus, where did you find that?! Presumably not on the website I provided you a link to. You need dpo@groupnexus.co.uk (dpo@groupnexus.co.uk).
This creditor is from UK Parking patrol office. I can't seem to find whom to send this SAR too, any ideas?
If you find the Privacy Policy page on their website that usually has contact details for the Data Protection Officer. Once you get a response to that SAR you should start a new thread on here for that charge - one case, one thread. It gets confusing otherwise.

The parking company I am guessing is the client which says CP Plus Ltd. I have attempted to find this but I can't find any parking companies with the CP name. Shall I call dcbl and confirm which parking company it is?
I had an issue with no flat number within the logbook so it may of been that but also there has been reports of missing posts for years on years in my building.
I was the registered keeper and I no longer own this vehicle anymore.

I've also received another one today which is from Debt Recovery Plus. This creditor is from UK Parking patrol office. I can't seem to find whom to send this SAR too, any ideas?

Most definitely not :-X
I will proceed to the data subject access with GroupNexus
-
CP Plus are part of Group Nexus: https://groupnexus.co.uk/cp-plus-landing (https://groupnexus.co.uk/cp-plus-landing).
Do not correspond with DCBL and definitely not by phone (are they the sort of company you'd like to have access to your phone number?).

Which parking company are DCBL representing?
For this to be the first you have heard of the matter, a number of letters must have gone missing in the post. Whilst this is not unheard of, it's relatively rare, so one of your first steps should be to identify why:
- Are you the registered keeper of the vehicle? That is, do you hold the vehicle's V5C document in your name?
- If Yes, get the V5C document out, and check that your address is correct
- If No, who is the registered keeper?
Another immediate step is to get hold of a copy of the original PCN and any other documents that may have got lost somehow - to do this, send a Subject Access Request (https://legalbeagles.info/library/guides_and_letters/court/subject-access-request/) to the Data Protection Officer of the parking company (not DCBL). You can usually find the details for the Data Protection Officer on the parking company's website, often under the Privacy Policy page.

I've received a letter from dcbl regarding a fine that was in 'MOTO Hilton Park North'.
First time hearing anything regarding this penalty charge and I have no idea where this is either.
I've looked online to see if I can view the PCN but i'm not sure what the PCN number is nor do I know what website to go on exactly.
Picture has uplaoded on different angle but there isn't much to see on the dcbl letter. I'll upload below.
Can anyone recommend steps to take?
