The restaurant just 10 metres away from where I was parked and disability is vertigo, knee problems, old age, can’t walk straight, other health conditions, on a wheelchair. It is my mother who has the disability.
Can you assemble some medical evidence to send to the council? It sounds like we have some compelling mitigation.

@PCN fines well sorry to be brutally honest, but your representation was rubbish.

If you decide to carry on you really must get our help drafting the formal representations, which we can start working on now.

How far was the restaurant and what is the nature of your disability?

@PCN fines OK so it sounds like there might be some compelling mitigation. We're here to help so you should take the free help, as going it alone will not end well.

When did you make the informal representations?

Ok sure sorry,
It’s just that it’s difficult with all the caring responsibilities and depression.
Any why that’s my problem.
I sent something already as  that 14 days was ending and I  didn’t get any response,
I wrote that -the PCN is invalid as the wording says of the 28 days period do not follow the legislative requirements as it should be date of contravention not the date of service.-
Didn’t know what else to write.

@PCN fines I suggest you draft a plea for discretion, but you need to be responsive and engage with us.

If you ignore us and go off and do your own thing as you did for your other thread (https://www.ftla.uk/civil-penalty-charge-notices-(councils-tfl-and-so-on)/pcn-received-at-twine-court-e1/) which ended up like this (https://drive.google.com/file/d/1Vx6qmpMmP4saMt8LHTEQ3D9bBkXt0bXL/view), then frankly there's no point in us even trying.

The contravention is made out and given you were right on a junction, I'm not surprised the PCN was issued. However the blue badge is strong mitigation, but it would be helpful to know why you were parked there, and how long you were parked for.

Pl get the photos from the council's website so we can see the degree of incursion into the prohibited area.

As it stands, these are the exceptions to what is a statutory prohibition - which is why signs are not required, a driver is expected to know and not knowing is not a defence.

Ss86(2) to 86(6): https://www.legislation.gov.uk/ukpga/2004/18/section/86.

I didn’t see anything on the floor other than double yellow line it was night time, no signage,
No signs are needed.

You were right by the clearly marked crossing point, (the knobbly paving stones). Here are the knobbly kerb stones on the opposite side thus indicating a crossing point.

Post by: PCN fines on May 14, 2024, 02:35:04 pm
Hi there,

I was issued with a PCN at 22:13 for parking on a double yellow line with a blue badge.
Contravention: parked in a special enforcement area on part of the carriageway raised to meet the level of footway, cycle track or verge.

I did not see any signs or extra road markings on the kerb like on the opposite side.

Any why I can challenged
This.
Thanks
