I have parked on Marchburn Dr, Paisley PA3 2SJ before with no issues for over a week. I parked here for 14 days while away on holiday. There was no clear signage saying I couldn't park there and there are always cars parked along the road. I've been given separate private parking fines for every day

..therefore we need objective facts, so post the docs requested pl - see reply #1.

If the keeper was not the driver then I WOULD NOT reveal this fact at this early stage - the fact can be used tactically at a later stage to derail the claim should it progress - the Claimant will moan about the later revelation but the Defendant can rebut such a complaint by saying that the law does not require the keeper to reveal driver details at any stage.
What tactical advantage is to be gained from this? If true, mentioning from the outset would seem to dramatically reduce the chances of a claim proceeding altogether (and arguably make the claimant appear unreasonable if they proceed having been availed of this fact).

Had a quick look on GSV.

The road has stretches with double yellows and stretches without.

This might well constitute contradictory markings (in terms of both common sense and the Code of Practice) if the matter is pursued on the grounds of 'no parking on the roadways' which is the normal angle these people state.

The Defendant can also make it clear (in their paperwork) that they will not be revealing the driver under any circumstance - the Defendant will point out that this is a contract dispute and not a dispute under traffic law and therefore the Defendant has the right to remain silent (not reveal the driver) in the circumstance does not require them to provide such information.

If asked under examination the Defendant can simply reiterate their legal position - quote from VCS Ltd v Edward if needed.

This will probably be a drawn out process.

Exactly what the signage says here is likely to be important - whilst they will only have formed one contract, that contract may entitle the operator to recover a £100 charge for every 24 hour period.

I'm not familiar with the Scottish system - can a defendant opt for a hearing on the papers? We normally advise against this (as it reduces the cost for the claimant, thereby reducing their chances of discontinuation), but if it avoids questions the defendant may not wish to navigate, it could be advisable. After all, it is for the claimant to prove their case, not for the defendant to disprove it.

A quick look at GSV shows that (in 2024 at least) there was a sign at the entrance saying that Glasgow Airport Byelaws applied in that area. You would be well advised to look them up and see what they say about parking.

As stated, you probably also want to do the following:
1. Go back and get pictures of current signage.
2. Appeal as keeper. Don't name the driver. There's no keeper liability in Scotland so they can't transfer it to the keeper.
3. If you weren't the driver, say so. If you were the driver, don't lie. Just keep quiet.

However, the value of the claim puts you in a pickle. Parking companies don't normally do court in Scotland because the value of the claim is such that they can't recover expenses so hiring a lawyer is a waste of money. For a claim of £1400, they could claim expenses of up to £150 if they win, which might make them feel it's worth a shot.

If they send a lawyer to court they'll have an opportunity to ask you (the keeper) who was driving. I don't need to tell you how bad an idea lying in court is.

They know your identity as keeper. If you have any social media photos showing you on holiday for the 2 weeks you were parked next to the airport now would be a great time to make sure they're private.

If the worst comes to the worst and they do take this to court, you may also have a partial escape route. They've said that the contravention is no parking at any time. The vehicle was parked once, so one ticket is potentially valid. If they'd issued one ticket for £1400 saying it's £100 per day then fine, but they haven't. they've issued 14 tickets, which implies 14 separate contraventions. But if the driver was in Benidorm for the entire day the car was there and never touched it, they can't have formed another contract. This avenue will likely depend on the signage and / or the byelaws.

Despite no keeper liability in Scotland. Given the amount they may well consider as in the case of Carly Mackie. You can appeal not naming driver explaining the no keeper liabilities. I would consider obtaining any signs or lack thereof just in case they may move to court.

There was no clear signage saying I couldn't park there and there are always cars parked along the road. I've been given separate private parking fines for every day I was there so 14x £100 fines. Previous experience, other people parked there and no warning signs made me think there were no concerns.

The fines from CPM Car Park Management say: Reason: No parking at any time.

£1,400 of private parking fines is ridiculous for parking on a road without any obvious signage. It was the first family overseas holiday we've been able to afford in 10 years and this is a nightmare.

Please can anyone help?
