GSV is dated Feb 2023, and the markings are pretty well worn out on that view of nearly 3 years ago. The law is that if you park in a marked-out bay, the onus is on you to determine what restrictions may apply. However, here, even though there is a sign,  if you parked some distance from it, there is no requirement to look, because as far as you can see, there are no parking bay markings.

However, such is the greed for cash with councils, that it is almost inevitable they will reject any representations you submit as an immediate challenge. The next stage, if you don't pay, is the service of a Notice to Owner to the person on the V5C Registration Certificate (what used to be called the "Log Book", because it was a complete record of the keepers).

So the question is, are you the V5C holder and if so, is the address up-to-date ?

is there some text on that first bit in any legistlation I can copy and past in my appeal?!
Somewhere in the dim and distant past ! You don't need to quote anything, just say that as no bay markings were seen, you assumed that parking was available and unrestricted. You could also say that the council are no doubt aware that without bay markings, any bar restrictions sign they erect has no effect in law.

No bay markings visible whatever , so there is no duty to look for a bay sign. The contravention did not occur.

However, like all councils growing fat and comfortable on PCN penalty income, they will reject whatever you write, so you must be prepared to take them to TPT.

If it hasn't already been asked, are you the owner, and the name and address on your V5C is up-to-date ?

thanks for your replies, would the best way to try and bat this off be then?? saying I didnt think it was an active bay as the markings are so badly worn??

Road markings, no.

Upright traffic sign(s), yes.

A council may, and must, dispense with markings for permit bays when situated within a 'Permit Parking Area' designated for those permits.


Otherwise, you are correct to the level of 'substantial compliance' with the regs.

Please post a GSV link to the exact location. Your photos show a complete absence of bay markings, but there would have been a sign by the bay, so, was there a sign ?
