Freedom of information request regarding Charge Certificates issued for the last year from 19th June 2025 to today

Please may I have responses to all the following questions within the statutory time period pertaining to all three legislations i.e. parking, bus lane and moving traffic enforcement?:

How many charge certificates have been issued?
How many have been paid?
How much income derived?
How many premature charge certificates issued?
How many have been paid?
How much income?
How many premature charge certificates have reached the Traffic Enforcement Centre and been rescinded?
How many have been cancelled while an appeal has been pending?
Pertaining to 8, how many have been successfully appealed at the Tribunal? (I attach a most recent case as an example)
Pertaining to 8, how many have you cancelled while an appeal has been pending and you have still pursued the appellants?
Who is responsible for the issue of these documents?

Complaint now with ICO. They are STILL issuing premature charge certificates even before the expiry of the NOR period.

Endemic problem which they fail to understand so this explains no FOIR response as they simply do not undretsand a premature charge ceriticate.

Dear Havering

Please consider the second link pertaining to Case No.: 2250453824.

According to the Respondent’s case summary :

‘The Notice of Rejection clearly states: “Remember you only have 28 days
from the service of this letter to do this and prevent a Charge Certificate
from being served.”

Therefore, the 28-day period expired on 4th September 2025, and the Charge Certificate was issued on 5th September 2025, which is compliant with the statutory process. The appellant’s calculation based on deemed service does not apply because the authority considers the date of posting as the date of service, consistent with the wording of the Notice.’

My proposed answer to this global madness:

Case reference 2250669743

Appellant

Authority London Borough of Havering

VRM BJ67GWN

PCN Details

PCN HG62152398

Contravention date 02 Jul 2025

Contravention time 08:21:00

Contravention location Ford Lane / South End Road

Penalty amount GBP 160.00

Contravention Fail comply restriction vehicles entering ped zone

Referral date -

Decision Date 17 Jun 2026

Adjudicator Mackenzie Robinson

Appeal decision Appeal allowed

Direction

cancel the Penalty Charge Notice.

Reasons

Mr  has produced a copy of a charge certificate he was served on 30 December 2026.

The tribunal accepted his application to appeal on 15 December 2025. The authority would have been duly notified, and should not have issued a charge certificate.

Paragraph 5 of Schedule 1 to the London Local Authorities and Transport for London Act 2003 specifies the circumstances in which a charge certificate may be issued. In these particular circumstances, a charge certificate could only have been lawfully issued if no application to appeal against the notice of rejection was made within the 28 day time period.

I therefore find that there has been a failure to follow the procedural requirements of the 2002 Act in relation to the issuing of the charge certificate.

Costa del sol. I speak cryptically, of course. If they can find a few grand for a barrister, they can give me a tenth.  All Havering residents should be asking serious questions.

@cp8759 beat the same barrister a few years back re the famous Ealing Bus Lane case re camera certification.

We can confirm that the Counsel’s fee is £4,104.17 + VAT to be paid from our Parking Budget.

@cp8759 cost me just a pint of Guinness. What a pleasant day.  ;D

This is the end of the beginning.

Believe it or not, I have just filed yet another appeal and they have already increased the charge to £240 before the lawful  period expires. They genuinely believe that the date of service of the NOR is the date of the notice.

Press will be on it very very soon as they say in Bridgend!

This must go to JR as they are ripping people off right left and centre.  >:(

This even before you make formal representations re the 2003 Act:

Please note submission of this form will remove your opportunity to settle at the discounted charge should your challenge be unsuccessful.

Illegality possibly and procedural unfairness definitely and fettering. Anyone reading that would most probably throw in the towel. UNLESS THEY COME TO US!

F -  There has been a procedural impropriety by the Enforcement Authority
G -  The traffic order contravened is invalid
H -  The Notice should not have been served because the Penalty Charge had already been paid

I understand that a false declaration on this form may result in prosecution or a fine, upon conviction, of up to £5,000.

In the immortal words of one tennis champion: You cannot be serious

F G H ARE FALSE!
