I emailed in an appeal and it’s been cancelled. See below communication

From me:

I am writing to appeal the Parking Charge Notice 510825136 issued to my vehicle. I can confirm I am the registered keeper of the vehicle F1 XNX

The allegation that the vehicle was parked is simply incorrect. The driver did not park at any point. The vehicle merely entered the area in order to perform a U-turn in front of your ANPR cameras before immediately leaving. There was no parking event whatsoever.

As the registered keeper, I will not be making any payment in respect of this Parking Charge Notice.

Furthermore, your Notice to Keeper fails to comply with the requirements of Schedule 4 of the Protection of Freedoms Act 2012. In particular, it does not identify any "period of parking" as required by the legislation. Instead, it relies solely on timestamps of entry and exit, which do not and cannot establish a period of parking—especially in circumstances where there was no parking at all.

Your notice also states that the "period of parking" relates to the time immediately preceding the stated date and time on the notice. That is an imaginative interpretation of the legislation. In this case, the driver was not even in your car park during the period immediately preceding the stated date and time, making your assertion not merely inaccurate but rather impressively detached from the actual facts.

Since there was no parking event and your Notice to Keeper is not compliant with Schedule 4 of the Protection of Freedoms Act 2012, you have no basis to pursue the registered keeper for this charge.

I therefore require you to cancel this Parking Charge Notice. Should you reject this appeal, please provide the verification code required to enable an independent appeal, together with copies of all evidence you intend to rely upon, including the full, unredacted ANPR records and a copy of the contract or authority permitting you to operate and enforce parking charges at this location.

I look forward to your confirmation that this Parking Charge Notice has been cancelled.

Following a review of the information available, we can confirm that Parking Charge Notice 510825136 has now been cancelled.

This case is now closed and no further action is required.

The NtK is non-PoFA compliant for many reasons.

I would add a sarcastic line in my appeal, namely;


Your notice states that the period of parking relates to the time immediately preceding the stated date and time on the notice - in this instance the driver wasn't even in your car park in the preceding time period!

Yes, it’s silly, and shows how greedy these parking companies are.

In your shoes I would “appeal” saying something along the lines of


There’s probably not much point saying much more, because they’ll likely reject your appeal “after careful consideration”, forcing you go make a more detailed “appeal” to POPLA.

What a silly charge. Apace car park, UB3. The driver used this area to do a U-TURN and ends up getting a parking charge.

Addressed to me correctly as the registered keeper.
