Title: Re: HM COURT claim form. DCB Legal on behalf of Spring Parking LTD.

We need to see the PCN to be able to answer this question properly. Given that you haven’t responded, you haven’t identified the driver, which is good, and may mean that you can not be liable as the registered keeper.

I will get a photo of the signs. It was a 'I just didn't look,' but I will provide some more information soon. Any other potential argument I can use?

22 June for defence/AoS
6 July for defence if AoS filed

If the signs were unclear/hidden/vague/contradictory then they may help your defence. If you just didn’t look and assumed then maybe not.

Can you post the PCN? It may be important. If you don’t have it, send a Subject Access Request to Spring Parking.

Imgur is blocked in the UK. Many of us, myself included, don’t use a VPN to circumvent this.

We need to see stuff, please read https://www.ftla.uk/private-parking-tickets/read-this-first-private-parking-charges-forum-guide/ and post as requested.

Court fees have not been incurred. In due course the claimant will have to pay a court fee.
You have 14+5 days from the date on the N1SDT form to submit a defence or Acknowledgement of Service. If you file an AoS you have an additional 14 days to file your defence.

DCB Legal usually discontinues cases before the date of their having to pay the court fee, as long as the claim is properly defended.

Inadequate signage is a significant defence point. Can you get pictures of the signs?

I received a Small Claims Court claim from HM Courts via DCB Legal (Spring Parking Ltd).

I have not responded to any correspondence thus far, including the PCNs and the subsequent DCB Legal Letter Before Claim.

The circumstances surrounding the original PCN are as follows: I parked in a paid parking bay near a post office for approximately five minutes. I did not pay because I genuinely did not notice any signage indicating that payment was required and assumed the parking was free.

I understand that, having not paid for parking, my position may be weak. However, given that court fees have already been incurred, I figured I might as well see it through.

If anyone has a good argument for me to put forward in my defence to help get this claim thrown out, I would be eternally grateful.
