Yh that is true I suppose.. I’m hoping they just pull out once I do my defence statement. Do you recommend I say anything in particular in my defence statement ?

The silver lining here is that you are a first hand witness to matters, and if needed will be able to testify (both in your Witness Statement and in court) to your honest version of events. This is arguably more credible than a third person account talking about what "the driver" did...

Yes, I agree, absolutely no way you could get out of that space if something was behind you.

Even if you tried to move forward first, those big steel bollards would stop you and you would risk damage to both your car and the bollards.

Thanks for the response.. so this is where i was parked right outside I remember it was around the time the new iPhone was out and it was completely mental in that retail park.. the Currys van parked at an angle blocking the click and collect and my vehicle but there was enough space for vehicles to get around it.looking back, I wish I took a picture now but I didn’t think about it as the manager said he will sort it out.  https://www.imagebam.com/view/ME1DTFCE

We can come up with something.

They will most likely pull out before any hearing as long as a defence is entered.

The driver has clearly been revealed so we are best off going with the truth on this one.

We can also introduce a further angle because the times are very tight - the argument is over 4 mins - this site is BIG so that 4 mins could easily be used get to and from a space and that does not even consider that you were blocked in and that this was beyond your control.

Were you parked in a space directly outside Currys?

Can you identify (roughly) which space that was on GSV?

Well I spoke to manager and he told me to write my license plate down and he will put it in the system which I done.. I even went back to that Currys last Wednesday to try and speak to someone about it and just my luck there’s a new manager there.. I told him my situation and asked him if he could get access to the system where it could show what license plates have ever been recorded and apparently it’s not possible to get access to it from 3 years ago SMFH.
Seems as though nothing is going in my favour right now lol

From reading that reply, it would seem to be the case that you were blocked in by a delivery van. You mention having spoken to staff in Curry's about this. Did you do so subsequently, and do you have evidence of this?

Your main argument would appear to be frustration of contract, insofar as you were prevented from leaving.

Ok. I received a reply with all the documents and I now can remember this situation. I’m not sure if my appeal might of F’D me over a bit but it was the actual truth to what happened. I wasn’t aware of this community back then so I guess I might have to take the painful L here.. I have the pdf format of there response what part should I upload on here other than what I wrote for my appeal ?

I had similar and sent the following to dpo@smartparking.com

SUBJECT- subject access request
PCN- your number
VRN - vehicle reg

Dear Data Protection Officer,
Under the Data Protection Act 2018 and UK GDPR, I am requesting access to all personal data you hold regarding me as the registered keeper of vehicle “your reg”in relation to Parking Charge Notice “your PCN number issued on 4th sept 2022.
Please provide me with a copy of all information you hold about me and this alleged breach, including but not limited to:
All photos taken of my vehicle (entrance, exit, and on-site).
All data logs from ANPR (automatic number plate recognition) cameras.
A copy of the contract with the landowner that authorizes you to manage this site.
All correspondence regarding me, including letters, emails, and internal notes.
A list of any parties you have disclosed my data to.
I require this information to assess whether the charge is valid and to verify that my data is held lawfully. I look forward to receiving this information within one calendar month.
If you require proof of identity, I have attached a copy of my driving license, bank statement valid within 30 days


I got all the info back within a week via email which I was surprised with, I thought they would also leave it till day 30.dont forget to include your ID, mine was driving license and up to date bank statement

Your deadlines are
8 June to file Acknowledgement of Service or defence
22 June to file defence if AoS filed by 8 June
If you obtain the original notice by 22 June you might be able to construct a defence.

If you can’t remember what you already said, with luck you will get it in response to your SAR.

I have not moved address since 2023, it’s so frustrating because I do not know what I would have said in that appeal, I’m really not sure if I identified myself as the driver. I guess I am screwed really..

Do you mean you filed an AoS? Or sent a SAR? Or both?
If so, what are the dates, we can’t see the original claim form?

If you didn’t appeal, or if you did appeal but didn’t identify the driver, it’s likely that Smart won’t have complied with the legislation (https://www.legislation.gov.uk/ukpga/2012/9/schedule/4) to transfer the liability from the unknown driver to the registered keeper.

Did you receive a letter before claim from a solicitor?

You have to file the AoS or defence within 14+5 days of the date on the N1SDT form, and if you file an AoS you have a further 14 days to file a defence.

Send a Subject Access Request to Smart for all the information they hold on you, which will include their original notice.

So 2 days ago I received a claim form in the post from smart parking limited for a fine I apparently received at Tottenham Hale retail park back in September 2023!. I have no recollection of this whatsoever, I have no idea if I appealed it years ago and if I did I have no idea what I would have said. This has completely caught me off guard since it was back in 2023 and only received it 2 days ago. I have to do an acknowledgment of service and then proceed with my defence, but i have no idea what I would say in my defence. Any help would be appreciated
