Thanks for the advice, that’s what I thought.
How strong is the case do you think? I don’t mind going for it but if in peoples mind on here it’s not worth it then I’ll have to stump up.
Funnily enough, my permit is due at the end of June so I’m waiting to see how if I get a reminder for that which might strengthen the case but I can’t wait that long and lose the discount so I feel kind of stuck

I don't think the issues with the notice of rejection would get this cancelled at the tribunal.
But together they may put the council off contesting it.
Your choice is to pay or appeal to the tribunal, which you must do within deadline.

Wow, that’s some information you’ve picked out there.
So you suggest I wait it out?
If I had been lax in getting a permit I would’ve paid but for them to not acknowledge something that people come to rely on, not working is my issue.

I would suggest that there are numerous procedural improprieties in the Notice of Rejection.
We will issue a CC;
Conflicting dates as regards the statutory period (28 days beginning on date of service ) and the council's bespoke date of 28 days from the date of the letter after which, by extension, £140 would not be accepted!
Undefined reference to the date by which an appeal must be submitted;
No reference to submitting an appeal outside the imprecise period;
No reference to costs.
The actual last day of the 28-day period for appealing is 14 June, with the lower sum being accepted until 31 May.
Wait for others.

When did you renew the permit and did that cover the period after expiry.
All you have is mitigation, which the tribunal can't consider although they can recommend cancellation with compelling mitigation, which this isn't.
If you take it to the tribunal your only hope is they don't contest.

Thanks for the reply. As per my letters I’m in for £70 because they have rejected my second appeal with evidence and have offered the discount which has 10 days left.
I think the PCN was unfair to begin with due to lack of reminder that they claim they sent.
Is it worth the tribunal or pay the £70? That’s the question.

What can I do now before it gets too deep financially?
The financial depth is £140, the amount on your NtO. Only if you ignore the NtO and any subsequent enforcement documents can it get any larger. If you end up taking them to London Tribunals, the £140 remains the maximum, there are no other costs of an adjudication.
The main point about the Notice to Owner is that you mustrespond to it, (pay or appeal it). As the discount option has now expired, it is a total no-brainer to take them all the way to London Tribunals, but first you must submit representations again to Hillingdon. They might give way at this stage and cancel, although it is very unlikely. What is more likely is they will re-offer the discount. However, if you are happy to have £140 at risk, you can, after they reject your reps, register an appeal at London Tribunals and present your case to an adjudicator. If you win, you pay nothing, but the council must prepare an evidence pack and pay the LT adjudication fee so it's a PITA for them, so they might not contest the hearing. However, you'll only find out if you decide to go for an adjudication.

Hi, I need some advice/help and knew this would be the place to come.
I received a parking fine from the council in December as my permit had expired and I didn’t realise. Now I know that the council doesn’t have to send out reminders and I have been through their t and c’s but this is something they usually do but didn’t this time. Being Christmas I wasn’t really thinking about my permit expiring.
I argued the case but they rejected it. I went back and they said that they couldn’t (wouldn’t as it turns out) do anything else until a NTK has been sent.
I argued the case again but gave them the evidence of my email inbox. I also quoted the transport act regarding being fair but they still claim that the reminders were sent out along with dates which I still dispute because a reminder has never ever gone in my junk folder and I’ve always paid on time. They have made an offer to pay the lower fine within 14 days but not to cancel.
I have attached the last 2 letters I have received but can get the previous also.
What can I do now before it gets too deep financially?
I have seen online something similar happen a few years ago in a different council.
