Also, with a date of November 2025, railway land was not “relevant land” under PoFA 2012 to transfer liability from the unknown driver to the registered keeper.
The law has now changed, but is not retrospective.

The response to the no doubt useless Letter of Claim should comply with https://www.justice.gov.uk/courts/procedure-rules/civil/rules/pd_pre-action_conduct#6.1
Quote
(a) the claimant writing to the defendant with concise details of the claim. The letter should include the basis on which the claim is made, a summary of the facts, what the claimant wants from the defendant, and if money, how the amount is calculated;
(b) the defendant responding within a reasonable time – 14 days in a straight forward case and no more than 3 months in a very complex one. The reply should include confirmation as to whether the claim is accepted and, if it is not accepted, the reasons why, together with an explanation as to which facts and parts of the claim are disputed
It’s normal that Moorside Legal comes nowhere near the requirement here, and their failure to do so should be observed.

Location: Leeds City Station

The Situation

I am the registered keeper. I have never identified the driver.

The vehicle was photographed stopping briefly. My review of UKCPS's evidence shows the vehicle was present for approximately 7 seconds (timestamps 15:14:23, 15:14:28, 15:14:30).

Critically, in the first image (15:14:23), the vehicle's brake lights are illuminated – proving it was in gear, under control, and paused momentarily in traffic due to an unexpected barrier at a previously familiar drop-off point.

Timeline

· 07/11/2025 – PCN issued
· 09/12/2025 – I appealed to UKCPS
· 19/12/2025 – UKCPS rejected (template letter – I have a copy)
· 22/01/2025 – I disputed with Trace Debt Recovery (email)
· 24/02/2026 – Follow-up email to Trace
· 25/02/2026 – Trace replied, ignoring my evidence
· 29/03/2026 – Moorside Legal Letter of Claim received (30-day deadline)

My Position

1. No stopping occurred – 7 seconds, brake lights on = momentary pause, not a prohibited stop
2. Keeper liability not established – I have not identified the driver
3. Amount claimed is a penalty – not a genuine pre-estimate of loss

What I Need

1. How should I respond to the Moorside Legal Letter of Claim?
